How does HBO get access to FBI wiretap tapes

that were never heard at the criminal trial because the judge said they were irrelevant to the charges?

Probably directly from the source. Depending on the state, it’s not illegal to record a conversation if one of the parties is aware. Sone states require all parties be aware.

The defense was not allowed to release before trial. Now that the trial is over, all bets are off.

You are actually both wrong. It was not “sealed” it is merely an FBI document that is not subject to public disclosure. Because of that it is not a public document.
If it was sealed, someone would be in contempt for allowing hbo to air it.
