I get piling on Davis here, but the real “criminals” are those who sent him these videos and the ones who filmed them in the first place.
Just receiving it and not deleting it is bad, but is it really a crime that should result in jail time? Seems like a gray area. If he didn’t forward or save the videos to his own device, I’m way more concerned about the women beating.
This just seems like PD trying to add extra to his case even though it’s compeltely unrelated

Whoa dude. I didnt say he wasnt guilty of bad judgement, above possibly other things. What is fact is that you can find him automatically guilty on another charge unless there is evidence HE did it.

I suspect the pornography charges were filed in order to entice Drake to testify against whoever sent them. The authorities want a conviction on who filmed and sent them.

Friends with tons of people...and tons of people who could send me something that could show something negative. And as an 18 yr old, I might not have cared enough to know I would be charged with something for not deleting.

But picture this..kid gets a text while sitting in class/team meeting/etc...he sees it's stupid or gross or both....closes app sonit wont be seen by anyone around him...goes about his business for a couple of hours and later he doesnt go back and delete it. Probably after sending and reciving 30 other texts from many other people that happens during his normal day. You want that guy prosecuted for child pornography?
I'm just not jumping to some hypothetical conclusion that he is a sexual deviant because someone sent him something. Is he stupid for not taking the actions that a responsible adult would, which is to delete? Absolutely! But I'll hold off on having him register as a sexual predator for the rest of his life until I get all the facts. Thanks

No. Because you somehow think it's ok to have pics of a 10 year old masturbating on your phone, regardless of how they got there. I get that you can't control what people send you, but you sure as frick control what you keep and what you delete. And you also control the actions you take when someone sends you a video like that.

The only thing I can imagine that MIGHT be defensible is some kind of crazy group text with some sick people in it.
The arrest warrant doesn't indicate whether or not he watched the videos, just whether he opened the text, and it doesn't sound like he was searching out child porn, just that it was sent to him.
I hesitate trying to even explain how this could happen, but I think it's plausible he had no bad intentions with the texts.
As for the assault, that's another story entirely.

Huh? Where did I say that? I said anyone who sent it should go to jail. From the information this far, it was just on his phone, NOT sent on.
So NO, I'm not ok with jailing teenagers because they didnt go they and erase something that was sent to them. As I said in other posts...maybe he was in class, recieved it, closed the app so others wouldnt see, and didnt open it back up and delete later on in the day when he was back on his phone.

Its weird stuff and he is guilty of poor judgment in not deleting it. That's all it really is.
