Any way the guy could've had the cracked or broken vertebrae before the incident just wondering...maybe from a previous fight but never went to the doc

Actually, not so much.
If this were to go to trial and the only evidence that pointed toward JJ being the kicker was AL's 'word' (and his friends' word), well, his lies in a police report cast doubt upon his 'word'. The video is a mess. Other witnesses contradict him. He's not exactly a stand up guy, between the prior conviction and the lies to the police. I've seen many an investigation where police and the DA's office advised the 'victims' to drop it because they could not win at trial and didn't want to waste money and resources (including a friend who was date-raped at LSU and who had *much more evidence* supporting her case).

He said I can't say for certain whether or not Jefferson fought at all. I did see him standing around while people were still getting into it.
That's called being honest. That makes him a damn good witness. It's a piece of the story -- not the entire thing -- but it's not like that's the only statement from the bar employees.
If Lowery was waiting outside to start shite, he's fricked. Every day this story looks more and more like simple battery will be the charge.
