The DA has enough for charges right now, but is looking to make sure they have all of the evidence necessary for conviction. DA's are evaluated based on prosecution rate and they are trying to fit the charge to the evidence. Could be the difference between first and second degree battery.

And FWIW, I think it's funny that the bouncer confirms that the truck wasn't trying to leave (as Lowery stated)....Rather, it aggressively drove right into the midst of the fight.

I think BRPD has enough egg on their face right now. They have an entire nation thinking they are incompetent by not even asking the bar owner and staff....its going to take a LOT of clear overwhelming HD Video evidence to push this thing much further imo

one of the worse beatings I've ever seen was from a guy who got pummeled and was laying on the ground crying for help...turned out he was getting a pair of brass knuckles out of his pocket. When the other guy bent down to try to help him up (after kicking his arse), the dude on the ground about killed the guy with three quick hits.

If the story is true that a punch happened in the bar, then the "victims" waited outside for the players to leave, that (to me) is pre-meditated. They were looking to ruff shite up. But they messed with the wrong crowd. They got exactly what they deserved...broken bones and all. If someone is waiting for me to fight, I will do everything I can to render him harmless, including kicking him on the ground. You don't like it? Don't frick with me anywhere for any reason. I don't play by rules when someone is waiting for me to engage in a fight. frick 'em.

Agreed...if Lowery story can be screwed with and proved he lied/bs the police then yes.
My point is that nobody has seen his official statement yet. Correct? You say he was drunk, he wasn't drunk the other day he went down to the station to give a statement. IF he lied he is screwed. My point was that nobody knows if he lied in his official report because nobody has seen the interview, which even you have admitted.
Lowery so far seems like a jack arse, but if for some reason he actully went to the PD and told them....hey I started some shite..etc...even though it makes him look bad then he may not be screwed when it comes to money suits etc. or even the charges.

from the video, it's pretty clear he was getting back up when he got kicked and after he got kicked. he was then helped up and ran off with the aid of another person.
