Wrong. The poster obviously does have a law degree. The analysis is on point...we’re off topic, but I needed to correct misinformation.
And that claim will not require suit, most likely. The liability insurer will pay all available coverage once the investigation is completed
Yeah...all it will take is a true piece of shite ambulance chaser to just convince one of the kids they can score some $$$ from an insurance company merely by claiming their father killed their mother.

I don't think you understand how much it costs these days for both two funerals and college tuitions, fees, room and board, and general living expenses for three students.
We can't speculate on the available insurances, or their general financial situation except to note that family friends had started a GoFundMe for them. I have no doubt that everything contributed will be helpful and appreciated in the next few years.

You obviously don't have a law degree. One car accident with your parent driving the other parent in their own car. Cannot sue dead people and no point suing your own inheritance.
I did not mean this in a negative way. I actually suggeted the Go Fund Me account in another thread shortly before Mick started this fund. In no way was I implying these have to be mutually exlusive nor that anyone is getting over.
No, i don't have a law degree, but i do have over 40 years in claims. Unless there is a family exclsuion in Georgia the surviving children of the mother would have a death claim under the insurance policy on the car. Certainly the carrier would make a reasonable offer as therei s apparent clear liability unless a road defect could be established . I don't mean to stray too far into the weeds, jsut wanted to share some options which might also help with college costs etc.

I did not mean the Go Fund Me is supertluous, just noting there are other avenues available to assist in addition. I am very proud of the Tiger Nation and all who have contributed and hope the children get everything they need to finish school and adjust to life without parental support.

road defect
The car hydroplaned. That's always a possibility if it has just started raining. The tires could be worn and not have good traction. Many possibilities as to the cause of the accident.
I also don't think the term "wrongful death" applies in this case. It doesn't seem to fit the scenario since it was a single car accident. I've yet to see anything anywhere that says who was driving. With a 12+ hour drive, it seems that they'd switch up.
Four or five years ago, I hydroplaned off of I-10 in MS and hit a tree. The car was sideways up against the tree and the bottom frame of the car took on the tree. Walked away from the accident with just a bruise on my right arm. Lucky to be sitting here typing this.
Wish the Ga Southern parents had been as lucky.'

$29,500K.
Do I hear $30K?
Glad the total is back to an even number.
Twice now, I've contributed to take away a weird number.

Yes, a hydroplane accident is scary. You may think you are driving safely for the conditions but the accumulation of water is not visible and your car loses traction.
The death claim for the passenger has a certain value range based upon a number of factors. She bears no responsibility except in some rare instances. The value might be mitigated by failure to wear a seat belt
Absent all of those scenarios, the issue then becomes one of who will be held liable in whole or in part. Obviously the driver, then other potential tort feasors can be identified such as a design defect in the road or the state's failure to address a defective condiiton, product liability of the tires or the vehicle itself.
Assuming fault lies with the driver there may or may not be adequate limits to cover the loss. This owuld allow underinsured coverage to be claimed. If more than one
vehicle is on the policy they may stack UM coverage if allowed by state law.
Attorneys are very creative in finding avenues to pursue against any and all potential defendants.

So glad to see it finally got a sticky... Incredible to see it surpass 30k. The Mick, you have done a great thing here, be proud. Thanks

This fund has received almost enough for 2 years' tuition for each kid at GSU. Depending on what year each of them are, we may be close to covering the rest of their college tuition.
