AT&T may tell you to move your fence

If they did they would have to make 5 other houses do the same. Might have to just let this on go.

Dude run that over. No one uses copper anymore. ATT disconnected phone lines and DSL that run through copper. If no one comes see you in a week, remove it.

Edit: didnt see it was still in use

It would be a damn shame if some crackheads snuck in there and tore out all that copper and took it to a metal recycler for cash. It was an epidemic in South Florida for a while where people were stealing A/C condensor units as easy as the newspaper in your driveway. I once had a claim where they went on to to the roof of a strip shopping center in the middle of the night and gutted about 15 units for the copper and stainless steel.

I'm surprised the guy that came out didn't raise hell about the fences being in the middle of the servitude, in my limited experience that isn't allowed they have to be on the outside of them with access to the middle.

It's not 1 big servitude. It's an original, likely 10', utility servitude across the back of the OP's lot/neighborhood. And a newer servitude across the back of the newer neighborhood (OP's backyard neighbor).

The fences are likely in their correct spots, on the 2 neighborhoods adjoining property line, with a servitude on each side.

Plant a garden there and hide it. I suggest black berries.

Sure would suck if a tree fell on it

Or someone dug a big hole in the ground next to it, pushed it over and covered it up with dirt.

Your best option would be to plant something to hide it.

Regardless of whether or not it was in a servitude when placed, they will argue that they have a ground easement at this point. Would have to go to court to prove otherwise. Either way you are paying to move

Never mind. I see it's still being used. I'd put one of those fake rock things over it, I guess. That's what I have at my septic tank because of the pump. I'm a roundup man, so stuff like that doesn't bother me.

The neighbors at the house across the neighbor directly from me are the asshats who secretly paid some workers to build another fence next to our neighborhood to make their lots look bigger, while also gating in the servitude entrance with a padlock.

I’m glad we live in a rural town, with rural neighborhood common sense.
