Just do it, feign ignorance/seek forgiveness later. There's not a ton or repercussions, I doubt LE is going to get too involved as long as you fix whatever damage.

Why is the op the neighbor from hell?
This just makes me sad. Why can’t people be neighborly? This sort of happened to me when building, some workers parked on their lot one day, next they had it flagged off with tape. I mean, come on.

Because I’m using the entirety of my lot to build my dream home? Interesting take.
This is a gated subdivision where pretty much every lot is only about 50-70ft wide. Almost every home takes up the entire width of the lot minus the 5ft setbacks on each side.
This thread is to ask questions what the consequences can be. There is a massive lot beside me that is empty and no plans to build on. Sucks the guy who owns it decided he doesn’t want to stick to our original plan and honor the signed contract/agreement we have to allow my team to use his lot to enter the back yard but ima do what ima do regardless.
The question is what can he do besides sue me and make me pay for the grass I run over

Something ain’t adding up…….you have a “signed contract” with your neighbor to use his lot..lol. Sounds more like you’ve been a pain to your neighbor and he’s drawing a line in the sand…literally.

What’s not adding up? At the beginning of the build, my builder wanted to wait til the house was up to do certain work at the back of the house to make the build go smoother. They could have done said work in the beginning but stated it would be easier if we waited. This would only work though if the neighbor was cool with it
They drafted an agreement with the neighbor to make sure we would have access to the back through his lot if we went through with this plan.
Neighbor agreed and we both signed the agreement.

So you have a zero lot line house. Front facing carport.
What are they doing in the back that they can’t hire Mexicans or use a smaller piece of equipment. How about a couple of ride on skid steer or a mini excavator.

Trying to wrap my little brain around this whole thing. 50-70’ lots, Lafayette, $250k, this is obviously one of those rowhouse developments with extremely nice houses but close together.
Some of y’all are skwakkng that he’s building too close to the line. A) this is how these neighborhoods are designed, B) if it’s allowed by code and restrictions, he’s good, and C) that 5’x2 on each side is essentially 15%-20% of his lot width. Of course he’s going to use every inch. Yes, if this was the country and you built right up your neighbors arse, “c’om on, man”, but this is what the op and the neighbor signed off on.
This is actually well above and beyond. Kudos to Your builder for thinking about constructability in the front end. If you have this and it’s enforceable, the neighbor can get fricked. And it’s sad you have to have that attitude but man, people are just crazy.

What are you trying to build OP? A patio and need to get a small piece of equipment in I'm assuming like a bobcat?
I don't blame your neighbor, those jobs and equipment rarely leave the land unscathed. I'm going to guess your builder is sloppy and has left shite around and the neighbor doesn't trust you.
He also probably bought early on and didn't realize how close 5 ft is. From my time on a board when I lived in a neighborhood like this the 5 ft for both homes is a 1 hour fire break, its not really code per say other than for that reason. Given that, when you both have something like an HVAC that's barely enough room to move anything around on your own property line.

What would you do if on Monday morning you showed up and there’s an 8’ wood fence on his property line? Does the agreement address this?
this is all very confusing and also kinda dumb. Tell your builder to figure out another solution, or run over his lot anyway. Regardless both of you would be tossed from small claims court post haste for ridiculousness with prejudice
