Rat, the "reasonable man standard," is a bullshite argument here. RM standard is applicable to the person making the offer, not the person accepting it after clarifying the terms.
Offer and acceptance. Zupardo's offered. Tran accepted AFTER CLARIFYING the terms. Contract formed at that point. Period.
If offerer didn't like the terms, he should STFU and change the terms of the offer, which BY HIS OWN BITCHING he admittedly had this issue before. "REASONABLE MAN" would've changed the got damn terms by now.
And while his attitude towards the transaction may not have been racist, his assumption that Tran owned a corner store was. No different than assuming all Italians and Sicilians are gangsters and criminals, all Irish are drunks, and all Latinos are here illegally.
FYI, most corner stores in metro N.O. are owned by Asians, with Middle Eaterners running a close second. Very few are owned by Indians or Pakistanis, and almost none are owned by African Americans, even though most are in their neighborhoods.
Last note ... if I see a great deal on 2-Liters in the coming weeks, I'll be buying 50 of them for the upcoming Holidays and putting them in my garage. I bet you any money there will be absolutely ZERO bitching by the manager, nor will I be accused of buying them for re-sale at my corner store.

This is why we have judges. I don't agree with any of what you've put forth above. Not about the reasonable man, not about offer and acceptance, not about who owns most convenience stores, not with you buying 50 bottles of soft drinks at a time at retail.

There is clearly an offer and acceptance when a customer brings an item to a cashier in an attempt to pay. This isn't my opinion, but a basic concept of Contract Law cited in 1L case books.

Look, Rat ... I've always liked you. I like Zuppardo's. Always shopped there whenever I had the chance. Grew up shopping at the one on Elysian Fields and Gentilly. My Grandparents were personal friends of theirs from being in the same social organization.
But don't let that faithfulness to a business or friendship with a family cloud your judgment and deny the fact that the manager was an arse.

I worked for a banquet hall in high school and college. First only did food runner, then while in college I was responsible for stocking. Looking for wholesale deals and sales was part of the job on Friday/Saturday afternoons.
You develop some good relationships with stores to order something in bulk for you as well. They make a profit and you get stuff for cheap.
Trust me on that last one. my entire life I've dealt with ignorant or racist comments. But let me tell you, I just don't brush it aside and put up with ignorance anymore, I call it out.
Its not about having thicker or tougher skin, its about putting people in their place.
