Yeah, pretty sure Izzo's is just angry over past business dealings so they are inventing new things to go to court over. They must be doing pretty well, considering what court costs are nowadays.

I'd suspect the biggest issue is being purposefully iced out of contracts and overall restriction of free trade by Rouses. I'm no lawyer but there would seem to be a big difference between naming a type of business to restrict (no Tex-Mex within shopping center) and naming a specific business (No Izzos alowed in shopping center). I think the recipe thing was just the original bad blood generator.

Responded to the thread on the OT instead of here so reposting my comment..

So what is Izzo’s end goal here? It sounds like the situation is more personal, with what sounds like recorded phone calls with the landlord and one of their (Izz) employees being offered a job at rouses. . As others have said, burritos aren’t rocket science... can izzos have a say in a competitor having rice beans and protein to throw in a tortilla at probably half the price? I don’t shop at either of these places.

It’s also common for the “main” store in the shopping center to have a say who’s in there... Am i wrong here? Whole Foods contract wouldn’t allow Panera in their shopping center.

Really can’t imagine Rouses affected Izzo’s business that much to justify a lawsuit. Not that Izzo’s has ever blown me out of the water but, would HOPE they could twist a better burrito than a grocery store. JMO.

The difference between the WF/Panera issue and Rouses/Izzos is the Whole Foods restriction was generic "Bakery" category. Rouses specifically wanted Izzos blocked.

Ah, I see. So they expect that they’ll win and Rouses will give them a payout? Do you think that will actually happen?

Seems like a waste of time to me. Why does Izzo’s need to be in every shopping center Rouses is in?

I have no idea what the end goal is, it seems like a feud more than anything. Izzos lost management in Lafayette to the Rouses there. Rouses used the recipe book to start a burrito bar. Izzos won court order to physically remove the recipe book from the premises. Fast forward a few years, Izzos has a contract at Juban Crossing. Rouses signs but on the condition that Izzo's contract be retracted. Hatfields and McCoys. If I were Izzo's I'd likely hold a grudge as well.

Well if it was a matter of Izzo’s thinking they were going to be in the shopping center and then Rouses making it an issue of them being there, then that’s understandable.

All in all, seems personal and a waste of time and money.

They (Rouse's) buy up places that have consistently good hot food and plate lunches, and ditch everything that worked previously.

new shite has COME TO LIGHT

quote:

Izzo’s filed an affidavit in its federal racketeering case on Thursday, claiming a former employee, has confessed to stealing the chain’s recipe book and was hired as a deli manager for Rouses so he could use the book to set up a burrito bar based on Izzo’s “Roll-Your-Own” model.

The former employee, Patrick Dartez, says he stole the book in 2011, cut out the Izzo’s logo from the pages and brought it to the Rouses in Lafayette, where he used it to teach other employees how to prepare burritos and other foods.

This is so dumb. Not only is there no “burrito recipe”, but the burritos I get at Rouse’s aren’t particularly good. Their only point is to have tortillas as a vessel to shove a few things into my stomach.

Rouse's is going to claim that Mr. Dartez acted of his own volition and that they didn't know.

the Rouses location in Lafayette (Bertrand) has never had a burrito station. The location on Johnston has not either and was not open in 2011:

The Rouses in the CBD has had a burrito bar since it opened but their burritos are nothing like Izzos
