fine, lets just do away with all smoking regulation and go back to the way it was in the 70's. smoking in restaurants, shopping malls, hospitals.....all of it. we'll just keep all of our kids locked up in the house so the grown ups can have their "rights." liberty!!! wooohooo!!

I don't smoke and I don't support the law.

One of my favorite places in Shreveport is Noble Savage. Love that place. But they allow smoking, and while I was able to look past it, my wife cannot. So I haven't been in about 3 years. That makes me sad. But I wouldn't ever want the local government to tell the owners that they can't allow smoking within their privately owned business.

Who has the greater right?

A) An invitee's right to set the terms and conditions upon which he gets to enter a private business; or

B) The private business owner's right to set the terms and conditions upon which invitees are allowed to enter

What are you blabbering about? You mentioned the way things used to be. They are no longer that way. More needless regulation is not justified.

Lnchbox - every restaurant in your home city could join together and agree that you and you alone are not allowed into their restaurants...and, it's perfectly legal.

Why is it legal?

If a restaurants thinks in 2015 they could successfully run their business at the same level of profit by allowing smoking then more power to them. My guess is the market would force them to change their mind pretty quickly, as times change and this isn't 1957. But they won't have that chance to figure out what's best for their business - the government has already taken care of that for them.

Regarding hospitals, daycares, department stores, et. al. - I haven't seen anyone clamoring for lifting smoking bans in these types of places. Nice hyperbole, though.
