bullshite. There has NEVER been OSHA precedent declaring flus contracted from coworkers as an occupational hazard. Further, by the CDCs own admission, the vaccine does NOT stop spread and contraction. In fact, the ADA ensures that HIV patients are considered disabled and do not have to legally disclose their illness to coworkers or managers.

It’ll get struck tf down if it isn’t totally bungled.

Their strategy exactly is to keep on enacting illegal bullsh*t that does get swatted away by the courts. But with each and every edict and interim they happily note the numbers of unvaxxed still gets whittled down further. It is by sneaky, steady attrition these psychos hope to break down the final numbers to reach their 90% "GOTCHA!" goal.

Probably. I don't see how they could reconcile striking down the CDC's rent controls and not knocking down this OSHA mandate.

So is HIV, MERS, H1N1, Hepatitis, I could go on and on. shite, HIV is protected as a disability. Show me where a OSHA mandates vaccines for any illness as a condition of employment in the private sector. If it were upheld, where does it end? Boosters? Seasonal flu shot mandates? The vaccines are more therapeutic than preventative, so what stops OSHA by presidential decree from using ETS to impose BMI requirements? Forced cessation of tobacco and alcohol? All of these become fair game dont they? So much for freedom - suddenly OSHA is in charge of your personal healthcare decisions.

The reality is, OSHA ETS's are almost always shot TF down in court because they bypass judicial review. The proverbial ready, fire, aim approach.

Good point. If the pandemic doesnt rise to the level that the CDC can use ETS to put a moratorium on rent, how does the same court allow OSHA to use ETS to force workers to be injected?

Military rejection rates are running 100%. Expected, but it's just killing what little trust people had in senior leadership.

Not sure about contractors or civil service.

Stay as of right now... Feds have until 5pm to file response and then Plaintiffs have until 5pm tomorrow for response.

Sounds like it would be injunction next and then to USSC

Just looking at this mandate from the outside it looks like a slam dunk that it will be tossed. However so did Obamacare, and this is how I am trying to look at how SCOTUS will rule.

If SCOTUS used the circus reasoning that Obamacare is a tax within the governments purview then I fear one judge will side with Roberts and the liberals and do the circus gymnastics in their reasoning to say the Vaccine is a legitimate workplace requirement under OSHA. I am not saying it is but I do see SCOTUS trying to be all vaccine hip and friendly. I can see them being more concerned about what their ruling would have on the vaccine than our constitutional rights. Sad state we are in right now.

They should be compensated, just like the illegal families!
