It is rigid and typically in favor of the LEO, but my main point was that it's not "blanket" immunity like some people tend to think. The one that immediately comes to mind is Rodney King who won 3.8 million. I'm sure the circuit in which one attempts to sue is a significant factor, as always. Your road to hoe is probably a bit "easier" in San Francisco than it would be in Texas, for example. But your points are certainly valid.

Specifically, the investigation revealed no evidence to establish that, at the time the officer fired a single shot at Ms. Babbitt, the officer did not reasonably believe that it was necessary to do so in self-defense or in defense of the Members of Congress and others evacuating the House Chamber.

This is dumb as frick and you should’ve been embarrassed to post it as if it made sense.

I performed the Flesch Reading Ease (36.63), Fog Scale Level (17.26), and the Flesch-Kincaid Grade Level (14.48) on the passage - and you are correct. It is a college-level in terms of readability.

Sorry.

She probably shouldn't have been trying to climb through a window that had officers with guns pointed at it on the other side. I do feel for her family, but this is all on her. Bad shite can happen when you are part of a crowd that is invading the capital building.

Now do George Floyd. After all, Fentanyl and resisting arrest is a deadly combo

In my opinion, this was the right move

It was a high security situation and you have to err on cautious side.

A tragedy all the way around, but I believe the facts establish that she wasn’t a victim of a murder

I don’t blame her. I blame the radio hosts, politicians, and online commentators who misled her into believing the election was stolen

May Mrs. Babbitt Rest In Peace.

May the officer feel relief that he didn’t commit an evil act, but a tragic one

I'm sure you've acquired some sort of specialized knowledge that others may not have a valid claim to in some particular area or areas by virtue of schooling and/or on the job experience, but this is not one of those areas for you. For too many reasons to list. Just a friendly pointer on that.

As this requirement has been interpreted by the courts, evidence that an officer acted out of fear, mistake, panic, misperception, negligence, or even poor judgment cannot establish the high level of intent required under Section 242.

And yet, the DOJ was willing to prosecute a local cop not on federal property (chauvin) if the local jurors actually had the audacity to make a judgment based on the evidence and not public perception and fear.

I thought it was wrong when a police force exonerates their own...or is that just under certain circumstances.

Karma has a way of getting even and I’m sure it’s going to happen in this instance eventually.
