Baton Rouge man builds a levee around his house; promptly sued by city

A longtime resident in Baton Rouge will have to dismantle homemade ring levees he built around his property or face the city-parish removing them and sending a bill. The ongoing fight is spelled out in a court judgment that was signed in favor of Baton Rouge in April.
Ken Guidry owns a sprawling piece of property off Perkins Road between Bluebonnet Boulevard and Siegen Lane, and he's called it home for 35 years. He began to notice flooding concerns about 20 years ago as development ramped up at a rapid pace.
"If it wouldn't be for my levees, an afternoon shower would wash in my house," Guidry said.
Here's the problem....there were even less controls on development and requirements on finished floor elevation when he build the house in the 1980s. All newer houses around him are built up higher.
So even if they've established a better development plan; his house still exists. He should have the right to protect his non-conforming but perfectly legal home. If he were to build a new house on his land now, they'd require that he build up the house pad to a higher elevation to meet newer standards.
Another issue I see is that his little 1' berm didn't cause any real impact to the water level. You know what did? The city/parish and the state governments ignoring clogged drainage canals and creeks. They are filled with vegetation and debris from the last flood and were never cleaned up.
This is the same bullshite that's going to hit Ascension parish and Livingston parish. Neither of them have learned from the mistakes that East Baton Rouge made decades ago (and is having to deal with now).

I read this story yesterday. So they are claiming him surrounding his property with levees is blocking water from flowing around his levees into drainage? It never states how much property he has. Is this like a single acre? Multiple?
Would t that just be a berm or levee filled in?

It's several acres. But I think he just built a small berm around his house....not his whole property. You can actually see it on street view at the far end of Silo drive in Willow Grove.
On the other hand, there's a small creek that runs across his land into Ward Creek. If he's blocking his adjacent properties from draining into that, I can see why the city is pissed off.

Does the berm stop it? The poster above says it’s only around his house, not around his entire property. If that’s the case, why would they have an issue?

If the city can fix other drainage issues with the same runoff first, THEN they should be able to bitch at this guy.
Ward’s Creek, for example, is where water from his property is supposed to drain. Pretty sure that is the same creek which is clogged to hell and back behind LSU Rural Life which one of the mayoral candidates tried to raise awareness about during the election.

Maybe they should buy it.
I presume his house met all applicable standards outlined by the city/parish at the time since they provided permits for the construction of his house in the 1980s.

Yeah if Ward Creek wasn't a shite show, they would have to spend millions to widen it.....barely a half mile from this guy's house.

I don’t know all the specifics but if the natural flow of drainage is across your property prior to development, you can’t block it.
From what others have said above it sounds like his property has a drainage ditch/swale that feeds into Wards creek.
It’s a crappy deal though as you are right, the city will allow development all around the guy that floods him and not do a thing to stop it.
ETA: it would be interesting to know if the ditch on his property is a servitude or not.

Widen it? I would start by dredging the fricker and removing the debris caught up in it.

The levee is around the property, not just his house on the property.
The guy is getting the short end of the stick here due to everything being built up around him but I can see why you can’t just build levees around your property in the middle of Baton Rouge. The whole wards creek issue is such a cluster frick

If the property didn’t flood before all this few development was allowed, why should he have to raise his house up to compensate for the parish’s frickups?

He said he’s had enough and is moving so it looks like the city will get an opportunity to buy his land and take advantage of it. I’m sure someone else will buy it and build a neighborhood though
