At the same time, the parish attorneys are trying to move the case to another parish and asking for clarification on whether damages are capped at 1 million dollars.

The maximum amount recoverable in a wrongful death action in Louisiana against a political subdivision of the State of Louisiana for the wrongful death of any one individual, no matter the number of claimants or the number of suits is $500,000. Economic damages in the form of loss of support are recoverable by the family members. In the case of the children, until the age of majority. I do not see given the facts of the case how one even gets to the $2.5 million offer, much less $5M or $10M.

Which is why Morvant should have ruled, let the First and even Supremes ultimately rule, then this shite gets flushed out with the quickness.

Then, why did they offer $2,500,000? Actually, RS 13:5106 limits the general damage award to his family for his wrongful death AND his own conscious pre-death pain and suffering to a TOTAL of $500,000, not $1M. A jury can award economic loss established through lay and expert testimony to the family and there is no limitation on that amount, but given the lifestyle and potential income involved and the age of the claimants, I don’t see how you even get to the $2,500,000 offer that the government made in the first place. And, any award for economic loss (loss of support) would be reduced by the % of fault ascribed to Sterling himself.
This case should be tried and appealed if necessary.
