I think JBE is wrong that the original emergency powers law is unconstitutional. The Legislature can delegate their police power and they can take it back under their own terms.

My life doesn’t revolve around TD so I’ll take that ban bet. You guys are focused so hard on the petition and not enough on what it’s actually doing. It’s more than a petition and will more than likely be viewed as an act of legislation when this is in court. There are also specifics under the Health Emergency Act that will also make it difficult for the petition to really work.

I’m not advocating that we continue to wear masks and have restrictions, I’m simply providing insight into this situation and people are getting butt hurt. You guys have really have no clue. The courts have and will continue to support JBE’s COVID response.

Because the reach of the petition will be viewed as legislation when it goes to court, and legislation requires house and senate.

Then what is the point of including the ability to petition by either house in the first place? Why was it included in the state constitution if, in your opinion, a petition to stop an emergency declaration would be viewed as legislation?

ETA: also, it’s humorous to assume that the petition should be viewed as legislation, when the order itself is acting as self legislated law by the governor.

It shouldn’t have been in there in the first place and JBE is arguing that it’s unconstitutional. JBE has the support of the court. He won’t lose.

A simple majority of either chamber is actually less offensive to separation of powers principles and is a better safeguard of democratic norms than requiring both chambers.

The legislature chose to delegate their police powers under certain conditions and they can choose the terms by which they take back that power.

The federal emergency powers law is worse, and we saw that with Trump and the wall funding. Because the federal law required a concurrent resolution from both chambers, it allowed for the executive to seize power and because the Senate would not approve the resolution, it couldn’t be ended. The Louisiana law as written is actually more protective of the minority party and makes it harder for an usurpation by the executive.
