It's not just that there can be racist laws, but the racism can be how the laws are enforced.

What was the reasoning for discrepant sentences?

I've had a couple people I know quote the statistics on wrongful accusation rates being much higher, and then taking much longer for those people to be released.
At face value, okay sure that could look like something. Then I follow up asking if they were falsely accused for another black person or someone of another race. Obviously it is for another black person, so follow that up with asking why it might be that black people are more often mistaken for other black people, more than almost any other race. It could be racism I guess, or it could be that facial recognition technology still struggles the most differentiating between black people, than most other races. So, either science is racist, or...

Criminal Justice system based on its roots in the slave patrol then more recently becoming the war on drugs.
quote:
"The Nixon campaign in 1968, and the Nixon White House after that, had two enemies: the antiwar left and black people. You understand what I'm saying? We knew we couldn't make it illegal to be either against the war or black, but by getting the public to associate the hippies with marijuana and blacks with heroin, and then criminalizing both heavily, we could disrupt those communities. We could arrest their leaders, raid their homes, break up their meetings, and vilify them night after night on the evening news."
"Did we know we were lying about the drugs? Of course we did," he concluded, according to Baum.

Make a platitude but don't let anyone in on what you really want to obtain.
Shout the platitude - reveal its "true" meaning as events develop. Stick to the platitude - never change its vocalization - insist any deviance from the "true meaning" is de facto proof of the platitude's universal truth.
It is a frigging RELIGION - this is how dysfunctional religions form. Divide people over differences that are impossible to define or that reveal any permanent thesis. .

The war on drugs was never about ending drug use.

How about the different punishment for basically the same drugs. Cocaine was predominantly used by whites while crack cocaine was predominantly used by African Americans.
quote:
Congress’s passage of the Anti-Drug Abuse Act of 1986 created a five-year mandatory minimum sentence for possession of five grams (or just a few rocks) of crack cocaine. (21 U.S.C. § 841 (2006).) “Mandatory minimum” means just what it says: A person convicted of a first offense of possessing five grams of crack had to be sentenced to five years in federal prison. By contrast, under the 1986 Act a coke-snorting user had to be caught with 100 times that amount of powder cocaine (500 grams, or over a pound) in order to face a similar five-year mandatory minimum sentence.

Please read that quote, then read the disparity in jail times based on the same drug and tell me they were not targeting African Americans.

Affirmative Action Can't upvote this enough. It's is the most crystal clear example that exists.
AA has evolved over the decades. It used to be initiated by govt or courts. Now, most of it is initiated by corporations who want the good PR. And college admissions AA is not mandated by govt. They are striving for diversity at the expense over more qualified white and Asian applicants.

Not necessarily. If it can be proven that certain groups get more favorable sentences from the court system that would be an example of systemic racism that is subjective in nature but still has real life consequences. I don't know if that has been proven however.
quote:
If that's the case, then the whole discussion is a waste of time. There is no way to prove (or disprove) your statement.
It can be disproven but a lot of people won't like the results or methods. It's easier for them to cherry-pick a similar crime in non-similar areas and say "hey look this black guy got 10 extra years for this similar crime ... systemic racism!!!"
When in reality there are more variables that take place during sentencing. IE criminal history, showing remorse, working with police, variance among state laws, etc.

Wasn't it the Dems and the first white/black POTUS WJC that put this shite together?
It wasn't systemic racism, it was a mechanism to keep them on the plantation and destroy the family unit... Your ire is directed in the wrong direction...

Ill explain it:
-Black women are financially incentivized into having children out of wedlock
-Young black kids are not held to any kind of behavior or academic standard in public school. They develop an attitude that they are entitled to act how they want with little boundaries
-The idea that no matter how hard they try or work, they will be held down by whites is implanted and repeated constantly by the leftist authority figures in their lives(teachers, politicians, etc) therefore reinforcing the idea that learning is worthless
-When they get shuttled through to graduation they are directed to college. The ones that go are unprepared. They are told that their bad performance isnt a result of bad education through HS or laziness but rather because the curriculum is geared towards whites.
-The ones that dont go to college try to find jobs but struggle because they struggle to do basic things like read well, write well, speak well, and stay on task...the things kids in proper schools learn.
-This reinforces the idea that they cant succeed no matter how hard they try because of whites holding them down...that idea implanted in their minds by white leftist educators
-Some give up, resort to crime and drugs leading to increased encounters with police
-Due to laws like Biden's crime bill, many are put away for non-violent drug crimes
-In prison they lose hope and are radicalized into a more violent way of life
