My only guess is this judge is trying to make sure keeps getting invited to all the "cool" democrat cocktail parties. Literally none of this makes any sense.

Sullivan can do this but he’s just playing political games here, potentially, if he digs in and refuses to grant motion to dismiss.

He has two moves here:

Grant motion to dismiss; at that point it’s over.

Or

Refuse to grant motion to dismiss; at that point I would be absolutely floored if he wasn’t overruled on appeal. It would be a stunning exercise of deep state power commitment to uphold such a ruling.

A judge cannot Sua Sponte prosecute someone. Or revive a prosecution that the prosecutor dropped.

It’s not a stupid decision. It’s a decision he doesn’t have the power to make.
