I have no idea if Portnoy's serious or how Barstool fits with regulations, but AOC isn't wrong that this is usually a problem for an employer if they do it.

You get a free roll of the dice if you file a Board charge in the sense that the government investigates it for you. The Regional Director probably wouldn't do much if an organizing effort wasn't actually interfered with -- Barstool would just have to put some dumb posting on the wall. Portnoy would probably wear it as a badge of honor.

Unions have outlived their usefulness. Granted, almost every experience I've had with them has been negative. IMO most employees that are pro union are the ones who can't be (but need to be) fired, or otherwise protected from being a very shitty employee.
