Already talked to credit card company and they are going to refund the amount in a week or so.
But I wanna know who the frick did this. Sams says I need to file a police report before they will do anything.
Should I pursue or just say frick since Im getting my money back?

Credit card company will do it. Once they cancel the charges you are free and clear

I'd pursue. Sams has cameras and they'll likely catch the person

If you're getting your money back, let Sam's deal with losing the 3500 bucks.

File it. May prevent happening again if they got your info.

File report. Time stamps and security cameras may help authorities locate criminals

Your Credit Card company will pursue the charges (maybe)
I had the similar thing happen to a good friend - stolen card, utilized for online purchased as well as in person. He asked the credit card company as well as the online company for the shipping address and they would not provide to him. Sam’s would not show him the video - they both said if the card company pursues charges, they would get this information.
With this being said - screw it, your getting your money back.

Sam's should be able to get a photo of the person. They have cameras everywhere and the transaction will obviously be timestamped for them to check the cameras.

Cops won't do much if it's under 5k.
Some guy bought two 6,500 TV's from Best Buy on my dad's card a few years ago. The cop laughed at my dad and said "dude, your bank is going to refund you".

Sams doesn't do shite. All they're worried about is their money once the credit card company takes it away.

It’s a felony.
People like that will never change if they don’t learn.

That's not necessarily true. The credit card companies usually set a threshold somewhere around $500 so a police report will almost certainly be filed. At that point its how much Sam's cooperate and how much info they can get. If they have a time stamp and easily ID whoever did it they'll put out a warrant, but they aren't going to do a month worth of detective work either.

was it a credit or debit card? I am curious if one takes longer than the other to get your money back?
also yes, file a police report. I had my card skimmer-replicated and the a-hole thief tried a few times to get money in my town at an ATM at complete failure-YET when he was in Raleigh (over an hour away) at a POST OFFICE he hit my card successfully and got a 6 hundred dollar money order. The only way I found this out was by calling Raleigh and filing a police report.
I was so pissed off that I called the police detective back for a follow up. I was basically told the credit union would have to take it further-it was a closed case. I was so mad because I thought it was now a federal crime because he went in a post office somehow, got cash in an ATM and a money order.

In all likelihood, neither the cops nor sams is going to do anything about this.
