Rice, Ducks and staying legal

Just got in a lease not too long ago. The ole man leasing the place planted about 50 acres of rice so that he could crawfish it. He won't be harvesting it, so it'll be standing all year. Now he isn't planting it for us, and he clearly is making money crawfishing. The question is, can we go in and clear out a circle around the blinds a few weeks before teal season and stay legal? He planted rice about a week ago so if we were to clear it a month from now there wouldn't be any rice (bait) to really knock off the stalks, and subsequently the cleared space would be cleared months before big duck season and when the rice would come to a head...?

Appreciate any advice, I'd rather not let green jeans get me 2 years in a row.

How deep is the water? If he has ifcthe water is crawfish depth you might only shoot mergansers...

If it hasn’t grown and seeded, you can mow an open area down.

If any has made a seed head, you can’t touch it

From what I understand he’s gonna put water on it soon and there will be water on it for good.. he’s got a grate/ big piece of grated iron he said I can pull behind a bike to lay it all down. From what I read it’s like 4-5 months until harvest. If I lay it over in early October I should be good come November?

Id get it opened up as soon as possible.

Wouldnt take any risk raking later. Plus raking is a pain in the butt in mud

If he buffaloes it it’s legal. Manipulating it on your part for the purpose of hunting is illegal. At least that’s the way I have always understood the laws. Normal ag practices are legal manipulation for benefit of hunting is illegal.

No way I would drag anything behind a 4 wheeler. I I’ve even seen someone nock crops down using a different 4 wheeler trail to and from the blind nocking down crops is also illegal. Ha w a friend that got a ticket for that.

The key is " normal farming practices". On first crop it cant be touched if its already headed out. Second croo can go either way. Farmer may deem it not productive enough to harvest and at that point its consider done as far as a crop. U can do what u want then. But first head has to be harvested or left alone as far as hunting. Now if your farmer happens to drive his crawfish boat around in there.. not tour pblm

Thanks, I figured this to be the case. I'll probably give it a few weeks or until after teal season then I'll clear it out.

There is a problem I've thought up though... The old man will probably crawfish it this winter into the spring. If he's riding around and knocks rice over while harvesting crawfish I could still get hit with baiting... Lease has been paid for guess I'll just do all I can to keep legal.

Posted it while I was sitting with the reply open... I'd like to think I could point to me doing everything right in my power to stay legal. He's planting the rice to feed crawfish, he's harvesting crawfish. I'm traversing and hunting on open water (no rice). I would have effectively done nothing in regards to baiting. However, I'm "taking advantage" of him knocking rice into the water..

Am I really buffaloing if I am dragging it before it's even a developed plant? There will be no rice to hit the water therefore no bait...

We do the same thing as you. Plant roughly 50 acres for crawfishing after season. We poison our ponds and let them all die before flooding it. Don’t know if you have the chance to do that. But has worked good for us in the past

The only way you can do anything to it if it is headed out is with a combine. You can't ride it down with a 4-wheeler, bush hog it, buffalo it, snake kill it or anything. In fact, just riding a 4-wheeler to the blind and smashing some down could make it illegal if green jeans is wanting to be a dick.

This is a normal farming practice so I think you would be legal.
I would go clear your holes out as soon as possible to make it easier and its going to do a better job.

How many ducks is this blind killing annually? You sound like the worrying type, no way that rice heads out with water on it.
