BTW,
Even assuming the statement is 100% true, the ethical obligations regarding privileged information still applies.
There was clearly a lack of any notice and a reading/use of privileged information without consent.

If they're looking for evidence of a criminal conspiracy why would the post election emails not be just as useful as the pre-election ones? Did all criminal activity cease on 11/9?

Which privilege? We're talking about emails sent during transition so not executive privilege, and the vast majority of those emails aren't to personal attorneys so not attorney client privilege.
I say that in the knowledge that only an absolute fricking idiot would out the details of a criminal conspiracy they were involved in down in writing on a govt controlled electironic medium with a YUUUUUGE warning about nothing being confidential and everything being subject to Law Enforcement access.
(ETA: which you can interpret as me saying no there's not going to be smoking guns in the emails, perhaps a few people will be contacting special counsel in the next few days to apologize for misremembering things, but no Dear Vlad, send money and we drop sanctions type emails will exist)

The initial request was for 9 individuals, and now the total is 13. That actually implies that there are 13 transition team members who are cooperating and/or are being criminally investigated.
The Act he mentions explicitly grants ownership of some data and financial records to the government as a condition of using the equipment / office space.

Edit: I don't think it necessarily implies that all are cooperating or under investigation. Could just be witnesses.

Don't be so sure. If all that was used was a web address (and server) but the equipment was theirs (they ran the transition from Trump Tower as I recall), they may have an argument.
Regardless, it does not address the privilege issues, and the ethical obligations, which are the main point here.

Interesting that Mueller calls it an "investigation," and not a "matter."
Also, since it is a criminal investigation (his words), there are procedural steps they must follow, which apparently were not done here.

What happened: Axios reported yesterday afternoon that officials of Trump's Presidential Transition Team, his office for the 73 days between the election and the inauguration, discovered that Mueller had obtained huge caches of emails from the General Services Administration, the government agency that hosted the transition's "ptt.gov" emails.
What's at stake: We're told that the fight involves emails from the accounts of 12 officials, including members of the political leadership and foreign-policy team. One of the accounts alone includes 7,000 emails.
Trump officials discovered Mueller had the emails when his prosecutors used them as the basis for questions to witnesses, the sources said.
Why it matters: The transition emails are said to include sensitive exchanges on matters such as potential appointments, gossip about the views of particular senators involved in the confirmation process, speculation about vulnerabilities of Trump nominees, strategizing about press statements, and policy planning on everything from war to taxes.
"Mueller is using the emails to confirm things, and get new leads," a transition source told me.
Taking the fight public: Charging "unlawful conduct," Kory Langhofer, counsel for the transition team, wrote in a letter to congressional committees Saturday that "career staff at the General Services Administration ... have unlawfully produced [transition team] private materials, including privileged communications, to the Special Counsel's Office."
The seven-page letter, obtained by Axios, says: "We understand that the Special Counsel's Office has subsequently made extensive use of the materials it obtained from the GSA, including materials that are susceptible to privilege claims."
The letter says this was a violation of Fourth Amendment protections against unreasonable search and seizure.
"Additionally, certain portions of the [transition] materials the Special Counsel's Office obtained from the GSA, including materials that are susceptible to privilege claims, have been leaked to the press by unknown persons."
