Sounds like the half assed grand juries in Travis county that keep indicting republicans and not proving jack shite

And Carter Page has been under a FISA warrant since 2014.

You are exactly right. Trump is fricked. He will be indicted for something...Kushner and Bannon likely get indicted too.
Pence will be the incumbent candidate against a Harris/Castro challenge...maybe Harris/ Booker.
Who knows how that will go down.

"A grand jury must serve until the court discharges it" -FRCP 6(g)
quote:
(g) Discharging the Grand Jury. A grand jury must serve until the court discharges it, but it may serve more than 18 months only if the court, having determined that an extension is in the public interest, extends the grand jury's service. An extension may be granted for no more than 6 months, except as otherwise provided by statute.
Also, considering I would imagine that the location of the grand jury can be challenged under (b)(1).
Of course, there's also this:
quote:
(2) Secrecy.
(A) No obligation of secrecy may be imposed on any person except in accordance with Rule 6(e)(2)(B).
(B) Unless these rules provide otherwise, the following persons must not disclose a matter occurring before the grand jury:
(i) a grand juror;
(ii) an interpreter;
(iii) a court reporter;
(iv) an operator of a recording device;
(v) a person who transcribes recorded testimony;
(vi) an attorney for the government; or
(vii) a person to whom disclosure is made under Rule 6(e)(3)(A)(ii) or (iii).
Considering these are the only people that are allowed in the room when anything is going on (except for a witness, they are allowed to discuss their testimony unless otherwise ordered), there better not be any fricking leaks.

Obstruction of justice was one of the articles of impeachment against Nixon.
Impeachment is not the same as a criminal investigation with a grand jury. Impeachment is a political process, not a legal one. The House can impeach for any reason whatsoever if they have the votes.

The president cannot "obstruct justice." It's literally impossible. He has the power of the pardon -- a pardon that is not judicially reviewable. All he has to do is call Mueller and say "I am pardoning everyone of my associates. Have fun with the investigation" and there's not shite Mueller can do about it.
Whether the sitting president can be tried in a criminal court while president is an open debate amongst legal professionals, since there is not a whole lot of precedent for this. Though I am sure Trumpers will prefer to only look at the arguments of one side, which aren't weak, and the conclusions do lean heavily in that direction, but the president is not a dictator and our constitution made this very clear with how they organized the checks and balances to not be beholden strictly to criminal law.
Obstruction was part of the basis of the impeachment charges that were brought up(or planned to be brought up) against both Nixon and Clinton.
But ultimately that check and balance is only as good as the people in power of it. Trump could theoretically find a way to fire Mueller, preemptively pardon people, then tweet about how he did it specifically to end the investigation that was looking into him, but if congress doesn't act, there is a good chance Trump would not face any formal repercussions.

Trump and his staffers would be wise to dispense with the lying at this point. The constant lies, omissions, and revisions to previous statements and documents will matter now.

Your vox article doesn't quite Mueller or his team. It cites two unnamed sources. Still, you should probably know it isn't my assessment....this pesky federal judges have already made the call.

Good luck with that. It's not in Trump's DNA to tell the truth.

pardons do not extend to impeachment proceedings. Nixon also impeded a congressional hearing. Trump is accused of obstructing an FBI investigation. FBI investigations are specifically not a proceeding under the obstruction statutes.

quote:We're way past FBI investigations. And more info comes out regularly. Obstruction is definitely possible.
Obstruction is a non starter. FBI investigations are specifically excluded as a "proceeding" under the obstruction statutes.
