I forgot in my post, UNARMED. So why does the gun come out? That should have ended things and no one would be dead.

So you were there? I didn't see the whole conference, was Gasser injured? Were McKnight's knuckles bruised?

Maybe he didn't want to risk his life fighting a 200lb professional athlete?
I'm not saying the shooter doesn't deserve blame, but I take issue with the idea that we should have fist fights with strangers who can obviously overpower us instead of using the means of self defense to prevent them from harming us.
On the other side, though, I don't think people should get off scot free if they willingly participate in a road rage argument that ends up with the other person dead.
If you aren't willing to deal with someone without shooting them, don't talk shite.

You just changed your entire argument.
If this is truly a self defense situation, how would the shooter know if the attacker was unarmed? Was he given the opportunity to frisk him first?

Very few psychologists on this board.....the issue is whether or not it was a criminal act....based on the statute it doesn't appear to be.

There's no duty nor obligation to threaten to shoot someone. If that level of force is justified, you take it. If you reasonably believe you are at risk of being attacked with lethal force or serious bodily injury, you have the right to defend yourself without first threatening your assailant.

We don't know that based on what we know. Maybe, maybe not.
You are entitled to use deadly force to protect yourself even if the other party does not have a gun.
And I don't know if the use of deadly force is justified here. Neither do you. You can't know based on the info we have.

If the guy went after him to physically harm him, I don't see the issue here. the guy was reportedly in his own property.
You let people just walk up in your house and frick with you?
