Bisbano’s owner: lawsuit could shutter business

A local restaurant owner worries a pending lawsuit could close his business.
The lawsuit alleges that Bisbano’s Pizza Parlor does not provide an entrance, restrooms or parking for those with physical disabilities.
The restaurant also has no accessible entrance to the bottom floor cellar, a late-night spot for live music.
“I can’t afford an attorney, and I can’t afford to do the renovations,” the restaurant’s owner George Petro said. “I can pay the employees and pay the note on this place. But believe me, I don’t have a wife at home living off of the income from this place. It takes two incomes for us to survive.”
Lafayette resident Liam Doyle filed the lawsuit last Thursday with help from the Advocacy Center of Louisiana.

Petro said he told Hahn earlier this year he would look into designating handicapped parking spaces and adding a ramp to the restaurant’s front entrance.
But Petro said he has not yet made those changes because he feared the advocacy group would push for him to add an accessible entrance to the cellar or construct bathrooms on the upper level.
“We had a good conversation, but it seemed like she was trying to intimidate me,” Petro said. “Making all of those changes would bankrupt me.”
If they close Bisbano's because of this guy, I will complain.

If it's an old enough building, they're grandfathered in, so what next?

That's usually how most of these groups work.

Moving a bathroom upstairs is no easy task. I don't really see this going anywhere but the legal fees alone will crush him. It's a goddamn shame you automatically lose because you can't afford to defend yourself.

Even worse when you're stuck in a wheel chair for the rest of your life and a guy promises to make a few simple changes for you then weasels out.

There is probably some hipster attorney that goes there that will represent him for free flat draft beer.

no promises made. Next argument.

Sounds like the guy I heard about who was going around suing barbers/hairstylists because their signage said "Walk-ins Welcome".

A weasels a weasels. He isn't saying that would be expensive. It's some paint in the parking lot and a wooden ramp.
He's saying he's worried about having to do more.
I hope he gets his arse kicked.

Bisbano’s, which opened in 1975 in an old house, has been owned and operated by Petro since 1990.
That’s the same year Congress enacted the American Disabilities Act.
Existing businesses such as Bisbano’s did not have to meet the same standards as new businesses. But the ADA still required those businesses to remove barriers for customers with disabilities if they are “easily accomplishable” and able to be “carried out without much difficulty or expense.”
From the article.
ETA I feel like adding a ramp is easily accomplishable and can be carried out without much difficulty or expense. The rest of the stuff, not so much.

You're not a smart man, are you? You sound like an employee that has not the slightest idea of what it takes to operate a business.

quote:not business owners' fault this man is in a wheelchair. Handicapped people need to accept they have limitations, and one of those limitations is that they can't go every single place they want to go.

Why don't he just take his pizza money and go spend it where they have made accommodations and shoot the finger at Bisbano"s.

Making Bisbano's wheel chair accessible will not be easy.

Same here.

The problem is if you build the ramp you have to move the bathroom.
The owners are doing the right thing in not building the ramp.

quote:You ever been there? The only way to accommodate his bathroom needs is to put an elevator in the place. They could open up the back fence and put in a ramp, but he'd have to roll all the way out the door and around to the rear of the building, even if it's raining.

I've worked with the AAPD several times. Many are well-meaning. Many are whiny, terminology-fetishist bullies who expect the whole world to tap dance at their behest.
The place has been there since 1975, and this one guy is the first to file a suit. I think there's more to the picture than his sob story, and if the place closes, he's gonna be reeeeel popular around town.
Posted on 9/10/15 at 1:10 pm to blueboy
I feel like this suit is less about the opportunity to go to Bisnano's in a wheelchair and more about an opportunity to make cash.
