Was driving down 290 in Houston yesterday and was stopped for a second in traffic when the driver behind me rear ended me. Hit the bumper and did some minor damage. I got the guys info and lucky for me he was in a company vehicle and had real insurance (State Farm). Guy basically said to me he was driving a manual and could not stop in time and hit me. I have Amica and have full coverage+ rental car. Question is would it be best to go through his insurance in this matter or go through mine. I know if I go through mine it might raise my insurance rates. Anyone have insight into this matter?

Step 1) Go to the emergency room NOW

Go through his insurance company.
If they are giving you shite, go through yours. Your insurance company will get their money back from in subrogation.
But ALWAYS go through his if you can.

If all else fails, i'd figure I would just get and attorney like Morris Bart or Jim Adler "The Texas Hammer" to get me what I deserve

still don't know why you aren't rolling around on the freeway holding your neck screaming about the pain.

Thanks for the good advice. Was leaning this way and now will do it.

I was in an accident just last week(I was hit by another guy...minor damage to my jeep and he caused an accident with a total of 5 cars involved). Not thinking I called my insurance(State Farm) when I got home. Next day I called his insurance(called my insurance and cancelled the claim from the night before) and am waiting to see how that pans out. They still haven't even come out to see the damage to my jeep. My insurance told me I can always reopen my claim with them if his insurance isn't willing to get my jeep fixed promptly or if they give me problems.
People are joking about injuries...but if you are having any pain might not be a bad idea to see your doctor or an urgent care.

I have seen serious and costly injuries develop/become symptomatic several days following a relatively minor collision. See a doctor if you have even minor symptoms - especially head/neck/back.
If you delay treatment and it becomes worse, you will have them claiming it wasn't caused by the accident.

It should not, as the accident was not your fault.

Why would you go through yours? He's got insurance.

Go through his insurance first. If his doesn't cover or you have issues, call yours. He has State Farm, you should be fine. Call them.
If your insurance has to cover for things that his doesn't (not likely), your insurance will not go up. They will go after SF or the company to get their money back.

Easier claims process.
Companies tend to treat you better if you are a customer/cleint than if you are with someone else.

I've never had a problem with other driver's insurance companies.

I generally contact my agent and ask her, and she either handles it with the other insurance company on my behalf or tells me I should go ahead and reach out to them and come back to her if I have any issues.

I would never just take someones info and leave. Always get a police report no matter how minor.
