The letter requests the IRS immediately provide a full and complete explanation as to why information about the disks was withheld, all documents and communications related to the creation and transmittal of the disks, and communications between the IRS and any other agency related to the 21 disks.

How many of these were Lerners during the relevant time period? How many contain her lunch plans?
And, last night you claimed they turned over ANYTHING they had. Yet, according to CNN, the Ways and Means Committee is STILL trying to get the Lerner e-mails.

Go back and read my edit. Most IT shops are loathe to run a mixed environment so when they make the decision to swap users over, they do so with the quickness. With ~90k employees they could transition out a computer for something NICE ($2k, which is/should be about 2x what they need to for a good desktop) for every employee for about $180 mill (which is just a small portion of their +1.8B annual IT budget).
With all that said, I would be shocked if they weren't buying new machines and just putting XP on them (because they apparently aren't spending their IT money on backups, amirite?)

Why would anyone think that an email from the IRS employee responsible for tax exempt entities discussing granting and/or denying tax exempt status to specific organizations would be emails created or received in the transaction of agency business? If she was doing her assigned job duties when writing or reading the emails, then it was in the transaction of agency business.
I suppose Lois Lerner was just acting as a concerned private citizen creating and receiving all those emails on the IRS mail server. Not even you can pretend Lerner's work product was not generated in the transaction of agency business.

You absolutely have no idea what you are talking about. There are a plethora of reasons why a company or organization would have still been using XP aside from the fact that it is one of the most stable operating systems windows has ever released. However, since that has very little to do with hardware, its moot. You still need to explain (older systems or not) how a "rash" of hard drive failures would plague a select few who just happen to be at the center of an investigation and in such a manner that zero data could be retained from them or any any other source for that matter.
I mean this is defending the indefensible. Do you realize how stupid you sound? Do you have any idea what the statistical probability of that happening is? Of 8 drives from a select few failing all within the same time frame?

As I posted, this is what my company is doing. We were going to go with 8, but when the company heard all the complaints, they decided to wait and we still have XP. I was talking with one of our IT guys last week, and he told me that we should start getting new machines with 8.1 in the near future. But, everyone (about 1,800 employees) will make the switch.
Now, given that Lois Lerner was the HEAD of the Exempt Organizations division -- a pretty high-up post -- do you think that she was working on an "old" machine, or is it more likely that she was always the first one to get the "newest and bestest" model when it rolled off the assembly line?

While it is very possible she was using older hardware, it's also possible that she had XP installed on a newer machine. Companies and agencies all the time use older software because it "just works". Considering that Vista had only been out 4 years and Windows 7 two years, it's not even unlikely that XP was still the choice OS around the office in 2011.

I hear you Bard, but again here is my experience. You are buying off a government contract and as usual you can buy a computer on open market cheaper. SO the $2000 may be low. I had that conversation many times when I was a Fed. I could walk into Best Buy and purchase a more powerful machine for half the cost. Also, budgets don't allow for new machines to be purchased for everyone every year or even very 3 years.
What I'm trying to say in all these posts of mine is this: It all looks suspicious and there may be wrongdoing, but what many of you are latching onto as proof and or indications may not be so and can be explained. Huge federal agencies, their business practices and budget implementations can't be compare to private companies (and that may be unfortunate).

I would agree if you look at one piece of evidence, but when you look at everything. The fact the the IG has already found targeting, the lack of cooperation, the evidence of Congress asking for targeting, the fact that confidential information was sent to the FBI for investigations, hard drives crashing, no backups, etc. You get a clear picture that there was illegal activity.

They don't have to be. This is a discussion about hardware and data retention policy. When you work for the government, they don't hand you special drives you don't see commonly used in the public sector. They are the same you and I use at home.
Hard drives have a median lifespan of about 6 years. Some last longer. Some fall well short of that. New equipment is purchased so there is sure to be a mixture of newer and older systems as time goes on. What I never see..........what I have never even heard of, is 8 drives irreparably crashing from a select few within the same time period. It defies the law of averages and logic.
