I understand why the laws are written the way they are. But common sense seems to go out the window with them in situations like that.

Was the attorney being a jerk? I'd imagine so. The truth in these stories usually lies somewhere in the middle. But I don't think telling someone not to take a sobriety test is interfering.

The past few cases I've seen have ended up with the charges dropped. There has to be a undeniable interference, video-ing from across the street in your own yard has yet to constitute "interference" in Louisiana courts (that I know of).

If BR pd wore the video cameras on their uniforms like other police departments, police misconduct reports would go down and crime in general would as well.

But they don't want crime to go down. They want it up. Justifying their jobs in a lot of ways.

After they are arrested, mugshot posted online, post bail, pay for an attorney, and miss work to deal with the charges.

Did you even read the statute that was posted? He did break the law. You may not like the law but it doesn't change the fact it is a law

And if they don't follow through with a suit against the police dept for false arrest, that's their own fault.

Before anyone brings up "qualified immunity" there has never, ever been a "clearly established law" that states videoing a police officer from a distance is illegal or even interfering.

So as long as it's safe for the officer, it's okay? I thought they were there to protect the public?

Last I recall more cops are killed in car accidents yearly than being shot by crazy people.

You also realize in this situation the attorney and cop know each other? So it's pretty safe to say officer safety isn't in question here.

Suing a police department for an arrest on charges that are dropped is not an automatic payment.

And it shouldn't have to get to that in the first place with common sense.

Yep. They've met in court dozens of times. This was a retaliation arrest.

Interference deals with interfering with the investigation. Dealing with the drunk passenger interfers with that.

Absolutely, but being shot in the face by the passenger or the back of the head by the driver while you are dealing with the driver will make you just as dead as a truck hitting you.
