No it's not my opinion, it says it very clearly I the statute

If an officer makes a traffic stop it is part of his "official" duties and if he suspected the driver was drunk and performing field sobriety tests, he is investigating. Anyone that interferes with that is breaking the law, lawyer or not.

Ok,

A cop is doing a roadside investigation.

The passenger gets out of the vehicle and refuses to comply with the cops instructions causing the cop to stop his investigation.

Due to officer safety concerns the cop cannot finish the investigation as long as the passenger is refusing his commands.

The officer arrests passenger for interference.

This is nothing new. There are already precedents supporting this.

The passenger being an attorney is a moot point.

Let's be honest. Cops are either pieces of shite and/or too dumb to make it in real world employment. It's just a bureaucratic way to falsely lower unemployment numbers while providing mentally challenged people with outdoor activities.

For both.

The passenger could be a distraction to the officer or a potential attacker.

The officer is responsible for the driver's safety as well. If he is dealing with a drunk passenger his attention is divided.

but I think you're projecting. it's clear to see that the officer realized who the passenger was and arrested him on a ridiculous charge because the lawyer had beaten him so many times in court.

Could have just released him on a summons, you know, like they did to the trooper that was charged with battery of an officer...

Wrong.

Again. It is moot if the officer recognized him or not.

If an officer instructs you to leave the scene of an investigation and you refuse, you are in violation of interfering with an investigation.

And a traffic stop is considered an investigation in the eyes of the law.

police report said he got out the vehicle and told his client to not say anything. clearly a criminal.

this is clearly the criminals the BRPD should spend their time on when BR is one of the worst crime ridden cities in the country.

Or the people that assisted in the beating of the family for filling up their car with gas at a station in "the wrong neighborhood"

I heard about that. the person who beat the guy up was given a summons. but clearly this lawyer was more of a threat to society by getting out the vehicle and telling his friend to shut up.
