It's not correct. Now if op was drunk then the cop can probably search the car for a gun if he first sees the CCW permit without a warrant.

The cop is allowed to take reasonable steps to insure his safety, but this was probably a little over the line. Asking OP to step out of the car would have probably been the better option.

This. I don't see what the big deal is. He's the one most likely to get shot in this situation. For all we know he's had someone pull on him and now he takes the extra step.

did he ask your permission to remove it? seems like he just wanted a reason to search your console for drugs etc.

How many people that pull on him show their CCW permit before doing so?

I'm no Billy Badass, but I don't plan on ever giving consent for an officer to go in my vehicle.

I did something similar when I was a LEO. I asked for the gun and after I mean the serial number I cleared it out and removed all the rounds from the magazine sns gave them back when I dismissed him. He was from FL and thought it was illegal and I told him no its perfectly fine but he can load the magazine e again after I leave and he understood my point. I let him go also FWIW.

I think it wasn't that bad of a judgement call. I've seen cops disassemble a pistol and throw it on a floorboard!!!

What if he refused?

With people impersonating police officers I would be hesitant to hand over a loaded weapon to someone I didn't know.

May seem excessive to YOU but put yourself in his shoes.

Go pull people over next week and see what it feels like walking up to a car with a stranger- then to learn he has a gun.

And having a CCW does not assure that any one "abides by gun laws" other than you abiding by the laws that allow you to carry.

"Law abiding" citizens have, on more than one occasion, opened fire on innocent people.

Big deal. Not every person's comfort zone is the same. He may have been a rookie cop too. I know one thing, an officer can never be TOO careful. When they are, that's when they could pay with their life.

Don't have a problem with that. He let you keep the gun. He secured it so he was safe. You shouldn't have a problem with it either.

Once you're down the road, get it out of the trunk and put it wherever you like. He's just making sure you aren't HIS problem.

I had this happen to me in Port Vincent but before I got my CCW. He asked if I had any weapons in the vehicle. I told him I had one under driver's seat. He went and unloaded it. After he gave me the ticket he handed me the gun and bullets. He then complimented me on my Colt revolver and suggested I clean it.

Personally, if he refused I would've pulled him out the car and had him lock the doors and stand on his trunk while I did my job. All kinds of ways to handle a situation.

If there is a weapon present and you tell the officer about it he has every right to secure the weapon and protect himself with or without your permission.

It is not a seizure. I don't seize weapons unless they are stolen or the subject was engaged in a felony but I do secure any weapons in the vehicle and separate the pistol from it's magazine and place them in the back of the subjects car and ask them not to access them until I have left the scene. Many people are crazy and having a concealed carry license does not mean that a person is not crazy and could decide to shoot me at any time. Granted this could happen on any traffic stop but I like to keep the odds in my favor when I can. I am not hurting the subject in any way, shape, or form by placing his pistol in the back of his car.
