Ebay "Item not as described question"....

I just sold a brand new computer mouse, never been opened. The guy filed a claim saying item wasn't as described. Of course ebay always usually sides with the buyer. They concluded he could get full refund upon return of item.
So they held the payment until he returned it, I just got the box back and it's an empty box. I looked and he had only 5 feedbacks and 3 of those the person leaving feedback are no longer a member.
Anyone else had this happen? Can I counter claim back, so I don't have to refund the $80?

Would of been nice, probaly would of kept it. It was some Gaming Mouse I won at some raffle. Thought I might get $15 or so for it, was pumped when it sold for $80.

I mean, they hold the money until the item is returned. And it sounds like he didn't return the item. So you should get your money back.

You're probably going to be out the money, ESPECIALLY if he used delivery confirmation on returning the empty box.
I used to do $2-3K a year in baseball card sales on eBay, but haven't sold there in almost two years, as this kind of BS became commonplace.
eBay is a cess pool now.

Agreed. I use Craigslist for my other "areas of expertise." CASH, IN PUBLIC, IN PERSON, no exceptions is the way to go.
There are a couple of places online that I still sell baseball cards. My total sales numbers are 50% of what they were 5 years ago, but my headaches are 99.7% less. For something that is only a hobby for me, it's much smoother sailing than my last year on eBay.

I mean I would at least file a complaint with eBay and definitely leave him horrible feedback

This is precisely why I would never sell a < $100 item online. There are enough scammers that it just isn't worth the hassle.

Hope you get your money back, but this is good info to have.
I sell stuff all the time on eBay and haven't ever had any problems, so I was completely unaware of this.
