ROY, Utah (ABC4) — A 24-year-old man was booked on Monday for fatally shooting a victim during ‘quick draw’ drills in Roy.
On Sunday, officers with the Roy Police Department (RPD) were dispatched to residence for a gunshot wound. The victim was transported to the hospital with a gunshot to the head wound, where they later succumbed to their injuries.
RPD Officers took an individual into custody, identified as 24-year-old Benjamin Davis.
Davis admitted that he and the victim were doing firearm drills, in which they would ‘quick draw’ their firearms and point the weapons at each other. Davis told law enforcement that he believed his gun was unloaded, pointed it at the victim and pulled the trigger, firing a round at the victim’s head, according to the probable cause affidavit.

"Both individuals are seen drawing handguns from holsters and pointing the firearms toward one another. During one of the drills, Davis draws his handgun, points it toward (the other male), and pulls the trigger. The firearm discharges and (the other male) is immediately struck in the head and collapses to the floor," charging papers read. Davis later told authorities he and the victim were practicing firearm-draw drills but that he thought his gun was not loaded.

A 2-year-old was in the apartment when the incident occurred and visible in the video authorities retrieved, leading to the charge for committing an offense in the presence of a child. "The child is seen walking within several feet of Davis and (the other person) while the firearms were being drawn and manipulated," charging papers read.
According to the police booking affidavit in the case, video taken from the apartment shows Davis after the shooting. "Benjamin is seen with a panicked expression, and he drops the gun," the affidavit reads.
The apartment complex where the incident occurred is at 4608 S. 1900 West. Davis is being held without bail in the Weber County Jail.

Take him out back and shot him in the head and just be done with this case.

You would think before doing an activity such as this one you would double and triple check that the guns were indeed unloaded

Is the news just using “they” now as a just in case or out of habit? This isn’t a case where the news didn’t know the sex of the victim. The report already stated that the victim was a male/man multiple times depending on edits of the report.
The article now looks different than quotes in the OP, but regardless of how often the report states that the victim was a male or a man “they” is used as his pronoun when his death from the gunshot in reported on.

In video footage from inside the home, both men can allegedly be seen drawing their guns and pointing them directly at each other. During one of the drills, police said Davis' gun went off. Investigators claimed a second angle shows Davis dropping his gun with a panicked expression after it was fired.
After being shot, the victim was taken to the hospital, where they later died.

This was stupid enough before reading that a 2 year old was around them while doing all of this and where the gun was dropped after firing.

Anyone that had a father that hunted and taught them everything about firearms would never think of doing dumb shite like this unloaded or not.
Treat every gun as it were loaded is like the first thing people are taught.

20 or more years ago two future robinhoods in Lincoln parish were shooting beer cans off each others heads. One of them was a good shot and hit his buddy between the eyes ending the game.
