Louisiana State Police Can Arrest Illegals for being Illegal Aliens

§112.11. Definitions
For purposes of this Subpart:
(1) "Alien" shall have the same meaning as "alien" as defined by 8 U.S.C. 1101.
(2) "Lawfully present in this state" or "lawful presence in this state" refers to a person within the borders of this state who is:
(a) A natural person who is a United States citizen, regardless of whether the United States citizenship was acquired by birth or granted because the person has met the requirements for asylum established by the United States Congress in the Immigration and Nationality Act, in particular 8 U.S.C. 1158.
(b) Legally present in this state by virtue of authorization by the United States Department of Homeland Security on the basis of any one of the following:
(i) The person is a permanent legal resident.
(ii) The person holds an unexpired student visa.
(iii) The person holds an unexpired work permit.
(c) Legally present or entitled to be present in the United States pursuant to an unexpired visitor or tourist visa, or pursuant to any other provision of federal law.
(3) "Unlawful entry" refers to an alien who is found entering or has entered into this state by automobile, watercraft, airplane, or any other method of entry or means of conveyance, whether or not entry is made directly from a foreign nation or indirectly from another state, without lawful presence in this state.
(4) "Unlawful reentry" refers to an alien who has entered, attempted to enter, or at any time is found in this state after the alien has been found to have been subject to any of the following:
(a) Denied admission, excluded, deported, or otherwise removed from the United States.
(b) Departed from the United States while an order of exclusion, deportation, or removal is outstanding.
(5) "Unlawfully present in this state" or "unlawful presence in this state" refers to an alien who is not lawfully present in this state because the alien does not meet the definition in this Section of "lawfully present in this state" or "lawful presence in this state".

§112.12. Unlawful entry or reentry into the state of Louisiana by an alien
A. The crime of unlawful entry or unlawful reentry is committed when an alien enters or reenters into this state and is unlawfully present in this state.
B.(1) Whoever commits the crime of unlawful entry or unlawful reentry into this state by an alien upon a first offense shall be imprisoned for not more than six months, fined not more than one thousand dollars, or both.
(2) Whoever commits the crime of unlawful entry or unlawful reentry into this state by an alien upon a second or subsequent offense shall be imprisoned, with or without hard labor, for not less than one year nor more than two years, fined not more than ten thousand dollars, or both.
C. It shall be an affirmative defense to a prosecution to the crime of unlawful entry or unlawful reentry into this state by an alien that either:
(1) The defendant is lawfully present in this state because the federal government has granted the defendant lawful presence in the United States or asylum pursuant to 8 U.S.C. 1158.
(2) The defendant's conduct does not constitute a violation of 8 U.S.C. 1325(a), relative to illegal entry into the United States.
D. This Section shall not apply to an alien unlawfully present in the United States if the alien has been a necessary witness to or victim of a crime of domestic violence, rape, sexual exploitation, sexual assault, murder, manslaughter, assault, battery, human trafficking, kidnapping, false imprisonment, involuntary servitude, fraud in foreign labor contracting, blackmail, extortion, or witness tampering.

give them $250 per arrest and another $250 when the bad hombre is deported and offer the same to all state police in every state in the US. The illegals would be out of here asap and the bonus $$ would go far in stimulating the economy..

This is actually a great idea. It is very black and white if you are illegal or not and there is no debate, it would alleviate the strain on ICE, and incentivize the State Police while stimulating economy.

Go have an interaction with a La State Trooper and refuse to provide an ID when they ask you for one.

Well then the Legislature has a judicial blueprint showing what can and can’t be done.
You ought to write a letter to your Stae Rep and Senator asking them to write a workaround law that gets the illegals in trouble while satisfying the court case. That way the politicians get a win, illegals get to go home faster to make their countries great again, your neighbors have more work and housing opportunities, and you can be proud for doing your civic duty

LSP can start by pulling over every 3 car convoy of illegals driving damaged cars bought at auction and driven to the border to be stripped for parts. This is rampant all over I-10 and I-12 at night (occasionally during the daytime too).
I have been told that the paperwork is a nightmare and that these guys typically just abandon their convoy on the spot if they break down or get pulled over. This shite needs to be stopped asap. They have no insurance, they don't belong here, they are illegal, and what they are doing is illegal.
I want to see more from the LSP on this.

They should. I remember back in the day the Feds funded DUI checkpoints. They should totally do this and check for proof of status while they’re at it.
