Court upholds Donald Trump's power to fire some federal agency heads LINK

A federal appeals court on Friday found President Trump can fire leaders at two independent agencies without cause, ruling their removal protections unconstitutional.
The 2-1 panel on the U.S. Court of Appeals for the District of Columbia Circuit said the restrictions on the president’s firing power at the National Labor Relations Board (NLRB) and the Merit Systems Protection Board (MSPB) violate the separation of powers

Hank and The1TrueTiger both assured me these firings were illegal

SlowBoasbergPro will say this is wrong.

One of the most significant legacies of Trump's time in office will be the reestablishment of the separation of powers.

This wouldn't have even bren a matter of contention for Brandon or Hussein.

This is not a win.
When a judge and court accept an argument that is clearly in violation of the rights of the executive branch, there has to be some avenue to discipline or remove a judge.
The DOJ should sue for removal of this judge for violation of oath, there should be no need for impeachment proceedings. At least drag their arse through the process....again....and.....again.

Agreed.
But you'll never see the Congressional GOP do this.

A better description is stripping Congress of its power and consolidating federal power in the Executive
This is just supercharging the bureaucracy (commonly referred to as "the deep state")

The judge was following Supreme Court precedent, aka the law.
The admin is seeking to reverse what our current law is. You want to punish courts for following the current state of the law.

Congress gives its power away voluntarily. This is just a step towards restoring constitutional norms that were lost over the last 100 years. The constitution is very clear about executive power.
"The executive Power shall be vested in a President of the United States of America."
That's as clear as it gets.

In this specific Case, Congress only gave away some power and the courts are taking more than what Congress ceded via statute.
quote:
"The executive Power shall be vested in a President of the United States of America."
That power is granted to the Executive by Congress. Whatever power there is to execute is supposed to be limited by what Congress creates.
This ruling strips Congress of its discretion (via statute).
These cases aren't the only attempt by the admin to strip Congress of its power, mind you. They're pushing the Unified Executive Theory HARD.

Correct - No GOPe would have dared to challenge a progressive POTUS' decision making authority. (But the GOPe will trip all over themselves to challenge / block DJTs authority)

This isn't ta partisan issue, b/c the next DEM President will have this extra power, too.
Remember when this beautiful bastard would stand up against Obama?
That won't happen anymore. The next DEM President will stack the FCC with all DEMs

Awr slow mo is so upset

Silly this even became a case. If the executive can't fire people in the executive branch, who can?

No it isn't. That is the power given to the President by the constitution, Article 2 powers. Congress's power comes from Article 1 of the constitution. Completely different. Any court powers (very limited) comes from Article 3.
Article 2 of the US constitution is very simple,
"The executive Power shall be vested in a President of the United States of America."
That's it. So clearly ALL executive power is in the hands of one man, by design of the constitution. Anything limiting that is unconstitutional and would need an amendment to change.

The FCC was stacked with dems.
The DC appeals court said it is OK for DJT to remove members stacked by dems at his own discretion.
This is real checks and balances.
