Penn State needs to offer Kelly & release the terms of the offer

Then if Kelly declines, LSU can argue that Kelly is no abiding by his contractual terms to seek other employment.
At this point,he would have to be next man up on the Penn State list.

I don’t think it’s stated he must take the first offer available. Just said he must show effort which is almost impossible to prove the contrary

Can BK legally decline jobs like that assuming the offers are fair market value for a tenured head coach?
I’d imagine LSU lawyers could easily convince a judge he’s not upholding his part of the contract if that was the case.

Agreed which is why we've tried time and again to settle but he wants the whole thing. In that case he better be hitting the pavement applying for every opening out there.

not sure how that works from a legal standpoint.
being required to do "look for a job" does not necessarily equal "take any job that offers"
so would need a contracts lawyer type to weigh in on that.
