Comey indictment misquotes Comey. Bad form for a prosecution involving what was said.

No one deserves jail more than James Comey. Unfortunately, there is only one criminal case pending against him.
In his 2017 testimony to Congress, Comey denied authorizing someone at FBI to be an anonymous source in news reports. Maybe that was false, but he is not being prosecuted for that statement because the statute of limitations has long expired. Instead, he is being charged with a particular statement he made in 2020. Here's the relevant part of the indictment:
The problem is he never said the words attributed to him in 2020. Here's the relevant part of the transcript:
Sen. Ted Cruz (R-TX):
“On May 3rd, 2017 … you were asked … ‘Have you ever been an anonymous source … in news reports …?’ … You responded … ‘Never.’ … Then you were asked: ‘Have you ever authorized someone else at the FBI to be an anonymous source … in news reports …?’ You responded again … ‘No.’ Now … Mr. McCabe … has … stated that you … directly authorized [him] … to leak … Who’s telling the truth?”
James Comey:
“I can only speak to my testimony. I stand by the testimony you summarized that I gave in May of 2017.”
Sen. Cruz (follow-up):
“So … your testimony is you’ve never authorized anyone to leak? … If Mr. McCabe says otherwise … is he not telling the truth?”
Comey:
“Again, I’m not going to characterize Andy’s testimony, but mine is the same today.”
NOWHERE in 2020 does Comey say the words attributed to him in 2020.

It is an interesting theory and something the anti-Comey types gloss over, for reasons we should all know.
Basing perjury charges off present comments on past (unprosectable) perjury is certainly a take.

I'm not a lib and I made it clear that I think Comey should be in jail. He's just not guilty of misleading Congress in 2020, because he never even said the words attributed to him in 2020.
Don't blame me. Blame the DOJ for not knowing how to draft an indictment.

The question of perjury today seems to be if Comey was untruthful that he stands by his comments in 2017 though. If he no longer supports them, then that would be perjury.

Are you making the point that the indictment is invalid because the quote is not what he said?
As in - if the indictment included the language he used in 2020 it might get a conviction?
Or is your point that the 2020 statement cannot be a violation of 18 USC 1001 (a)(2)?

You’re trying to claim him saying he stands by his testimony doesn’t mean he is saying it is truthful. It’s just dumb. Why do you pretend to be a lawyer on here?
