You need evidence to allege "termination for cause" or else it's defamation.

It appears that Governor Landry or his minions thought LSU could float rumors of reasons to terminate for cause in an effort to aid buyout negotiations. They seem to have thought that the rumors would provide leverage that would decrease Kelly's demand. Perhaps he/they figured that LSU did not really need an actual reason to terminate for cause, let alone evidence to support those allegations. "We just gonna put it out there to make Kelly squirm and negotiate."
The problem is that Kelly's attorneys questioned whether LSU actually intended to assert allegations to support a termination for cause. When LSU failed to concede the issue, Kelly's attorneys decided to let the 19th JDC decide if there was sufficient evidence. If LSU does not concede the issue or if they don't have any evidence, there's going to be a defamation lawsuit and possibly a claim for tortious interference with contract.
It seems that at every conceivable inflection point, Landry or his minions have failed to plan ahead.
It doesn't look like anyone calculated whether it was cheaper to keep him for some length of time, a week, a month, the remainder of the season, etc.
It doesn't look like anyone calculated how LSU was going to fund the payout.
It doesn't look like anyone analyzed, prior to his termination, whether LSU could terminate Kelly with cause.
It doesn't look like anyone gave any thought about a replacement head coach before terminating Kelly.
In short, the whole thing looks like it was handled by a five-year-old child who just wanted to have his way.

No, they won’t. They will end up giving him two options:
Take the full payout over 6 years but show proof that you’re actively looking for a new job, as required in the contract.
Or
Take a lump sum. Probably $40 mil, give or take a mil or 2

Brian Kelly is not an idiot.
He now has money to bring in the work of the best lawyers.
He'll get his 56M now and if he can prove defamation (and obviously harm has to be there -- not sure if it is yet or not -- probably not right now), he could get all together 75M. And in this case, he will not have to show that he's looking for work.

All he needs to show is that a single AD turned him down over concern for the "termination for cause".
On the same lines, wasn't the deal that we owed the OC a full buyout if he was fired before Kelly, but we didn't owe it because we fired Kelly 1st? Could he come back demanding a full buyout because of LSU's statements?

LSU would have to make a public statement or publish something that is false. Has LSU or anyone associated with LSU, to date, put out any information publicly about Brian Kelly that is false? Simply firing him is not defamation. And anonymous guys on the internet message boards gossiping about him is not LSU making defamatory statements either.

I 100% agree here. I think the dumbasses trying to negotiate this thought they could threaten BK with for cause termination to try to gain leverage through negotiations, but they are incapable of thinking past their nose.
