Supreme Court being formally asked to overturn Obergefell; gay marriage will fall

I have been saying this ever since Roe vs Wade fell. The only SC case with worse legal reasoning that Roe is Obergefell.

This SC is certainly going to come down 5-4 and just like with Roe say if you want gay marriage legal, pass it in the legislature. Expected to take this up in the fall

Wait so gay marriages will be illegal and grounds for persecution? Will it go back to the states and be legal in some states and illegal in others?

Obergfell is based on a few cases that established the reasoning, so the question becomes if it falls, do Loving and Griswold also get reversed?

Also Tim Pool is being over-dramatic. The USSC being asked to overturn a case is close to a nothing burger. There's a long process before the writ would be accepted.

There’s no way you had time to watch the entire 20+ minute video already. He goes through how this person is the only person with legal standing to challenge the precedent, and that it’s expected they will take this up in the fall session

Also as things currently stand if it’s returned to the states like Roe 35 states currently have marriage equality ban laws meaning gays could only be married in 15 states.

Do you mean "prosecution?" No one would be prosecuted for pretending to be married. There's no law against impersonating married people. They just wouldn't get the government benefits and privileges afforded married people.

That would be my guess.

Gay marriage never got much traction when it was up for public referendum before Obergfell but times have changed, so I would imagine that the vast majority of states would affirm and legalize at the state level.

Yeah, but I bet most of those would change quickly.

I would guess once the smoke cleared it would be the other way around, where there might only be 10 or 15 states in which gays couldn't get married.

I could be wrong, but that is what I would put my money on.

That's non-responsive to Tim Pool misunderstanding what the article he's discussing says.

This is an appeal from a civil judgment. It was laughed at, at every level and has probably a 1 in 1M chance of getting cert on that issue, let alone the unrelated attempt to overturn Ogberfell
