Court rules Arkansas can enforce classroom ban on critical race theory

The 8th U.S. Circuit Court of Appeals ruled Wednesday to allow Arkansas to enforce a classroom ban on critical race theory.
The three-judge panel rejected arguments from students that the state was violating their First Amendment rights by restricting the teaching.
“Since the Free Speech Clause does not give the students the right to compel the government to say something it does not wish to, they cannot show a likelihood of success,” the judges wrote, vacating a previous preliminary injunction blocking the state from implementing the law.
“With its ruling today, the 8th Circuit continues to ensure that the responsibility of setting curriculum is in the hands of democratically elected officials who, by nature, are responsive to voters,” state Attorney General Tim Griffin (R) said.
The attorneys for the students said the decision gives them “pause and concern,” The Associated Press reported. LINK

“Court rules Arkansas State government has oversight over Arkansas educational curriculum.”
Novel legal theories abound.

Exactly how does NOT teaching the critical race theory garbage violate the first amendment rights of students? Or rather, how did the students think that not being taught CRT violated their first amendment rights?

The premise is that CRT is rock-solid, airtight, historical fact.
If you buy that, then all the nonsense flows from that.

Slightly surprised to see that the judge that originally issued the injunction against the state law and was just overruled was a 2019 Trump appointee. Rodofsky, NYC carpetbagger, Ivy Leaguer.

If critical race theory included studies about race and IQ it would be the left sky screaming about it.

What if a student or group of students wanted Marxist and Socialism theory taught in schools. Nay, demanded! to be taught communism as part of their public schooling? The state and community have a compelling interest in saying, "frick, no."

And if they DID demand to be taught communism, and were granted their demand, then a group of students who demanded to be taught the Bible would also have to have their demand granted, would they not? But the very same students that demanded to be taught communism or CRT or whatever would be the very first group of students to file a lawsuit against the Bible being taught.

How about if you wanted to teach real oral sex in the middle of the classroom. Would that be OK in the name of teaching?

In a nutshell…blacks and non-whites are victims and whites are bad victimizers. What students were made to “apologize”to black students.
It’s utter bullshite.

There are lots of things that middle and high schools don’t teach… that you have to go out and learn on your own.
If you’re THAT energized about learning about CRT, then go spend your time researching it yourself. You shouldn’t be dictating the curriculum for everyone according to your niche interests.
But we all know what it’s really about… indoctrination. Teaching the young to hate their country. It’s sick.
