There has been a lot of discussion of this case on this board. I figured the District Court would do this.
My questions are:
- does the district court ruling limit the unconstitutionality of the law in question only as it is applied to green card holders, or also to people here on visas?
- when you get a green card through marriage does the "provisional" status (or whatever legal/technical term is used) only apply to the marriage itself? In other words, the green card is provisional only to the extent that the government is waiting to see if the marriage is a sham or not. Otherwise all protections/rights of a green card holder apply.
- Finally - what is the basis for revoking a green card? Only violent felony convictions? Seems weird that person can be here on a green card and engage in activities the government deems as adverse to U.S. interests but there is nothing the government can do.

This is the khalil case. Theguy who led the pro-Palestine/anti-Israel protests at Columbia. he was here on a student visa, got married to citizen and got a green card in October. U.S. detained him for removal on the basis of Congressionally passed statute that he was expressing ideas/speech that were adverse to U.S. foreign policy interests. Immigration Court ruled in favor of government, but he appealed to a Jersey or NY District Court (not sure which one) and they have ruled the statute unconstitutional at least as applied to green card holders.

Didn’t open link, but good. We should all support Green Card aka Permanent Residents. They came in the right way and are definitely more American than half of this country.
