Unless there is a threat of imminent lawless action, you can say that someone should be 86ed.

Comey deserves whatever shite comes his way but odds are he was vague enough to avoid being charge with anything.
You have to be pretty specific with threats, especially when you use slang or colloquialism. It isn't like he said "we need to pop a cap in his arse" which leaves almost no room for interpretation. 86 is used to mean "kill" but it is usually "get rid of" which is vague enough to let this slimeball slide.

Everything is free speech.
But, some people in certain positions, give up a bit if that. Their words carry more weight than the normal citizen.
I dont think comey is in trouble here, unless there's an incident that can be traced back to his post as motivation
