...and subject to the jurisdiction thereof... is a pretty key phrase. The Native Americans weren't granted citizenship until 1924 since they weren't under the jurisdiction of the United States. The Trump admin is arguing that foreign aliens that are here illegally and have children are also not acting under the jurisdiction of the U.S.
