I’m curious about the PT’s thoughts / level of concern about this? Do you support what the Trump administration is proposing here? Not about birthright citizenship, but rather the way in which constitutional legal battles should be fought and resolved at the individual / class action level.

“In perhaps the most consequential case of this term, today, the justices heard more than 2 hours of oral arguments in a case to decide whether one single federal judge has the power to issue a nationwide injunction that could stop a president’s executive order. The backdrop of the question is President Trump’s executive order to end birthright citizenship. Birthright citizenship is a constitutional right clearly defined in the 14th amendment of the constitution and has been interpreted by Supreme Court precedent for more than 100 years. Not to mention, a law passed by congress that solidifies that precedent.

I know this sounds like a wonky legal question but I can not stress to you enough. The ruling in this case is going to affect every single person in this country and depending on how the justices rule, could allow a president to move forward with illegal or unconstitutional policies in certain parts of the country.”

Well, the Court should at worst limit it to that district's circuit or say it applies to that district.

One problem is it applies to other Circuits that may have a totally different view of the issue. For example, a California judge's law is binding on the Fifth Circuit even though their jurisprudence is completely difference. Crazy.


Here in state courts, a Circuit or Chancery Court's decision is not binding on other districts. It is only precedent in that district, not statewide.

How is it that every other position has jurisdictional boundaries. Outside the parish or county where a sheriff is elected, his authority carries zero weight. A mayor can’t pass rules or write policies for a town in the state in which he’s not elected and his authority or jurisdiction doesn’t exist.

This holds true for every single position in ALL forms of government EXCEPT for district judges? They somehow have authority outside of th3 boundaries of their jurisdiction? And, they are totally unique in this distinction?

I don’t think so. They are operating outside the bounds of their authority and the Supreme Court needs to smack them down.

And what if that judge is eventually overruled?

Look how many babies have died from Roe. Its no longer the law of the land. I think thats far more devastating than what a prez might do as the Exec

Also, a Hawaii judge feels almost no effect from what goes on in DC. But he rules as if its a crisis within his district

Its not. And shouldnt be treated as such

Trump is a convicted felon. I think for all the seconds he would do something illegal to try and continue the corruption he has spent the first few months of his term instilling. His actions so far prove more than anything how we have given the executive branch too much authority. Thank god these hero judges are stepping in to try to at least stop the bleeding.

What is interesting about this quote is that the court used and interpreted English common law from the 1600's and it is not even true today - you do not become a citizen of England by fldripping a baby there
