Predictions on Khalil (former Columbia student) hearing today?

The immigration judge said she would decide today after the 1:00 (CDT) hearing whether or not Mahmoud Khalil can be deported.

She works for the Attorney General. 20 immigration judges were recently fired without explanation.

I predict that she finds Khalil subject to deportation. What do you think? [Not a question of whether or not he SHOULD be deported...there's been plenty of discussion already about that.]

I lean the other way. Deporting him on the seemingly sole basis of protesting against Israel seems awful thin, unless the Court is going to find that the SOS has absolute authority to remove people for any reason.

I'm waiting to find out myself.

Based solely on her response to all this right now. I get the impression she's going to rule against deportation.

There should be no court involved at all. The law is clear that the State Department can pull visas at their discretion.

Isn’t their something about illegal undesirables that pisses you off enough to take a stand against them ?

I think she's going to rule that people can be removed as long as the SOS articulates (proof is irrelevant) a reason for removal. In this case: to support the foreign policy of the United States by cracking down on antisemitism.

That just seems like it would open a door that we don't want opened.

I agree to some degree. I am not sure "proof is irrelevant" but the case should turn on whether the Secretary's declaration is reasonable. I think it is reasonable and therefore I think the government will ultimately prevail, but I am not sure how this particular judge will rule. If I had to guess, I would guess she orders him released and this goes to the next court.

Holding a student visa is subject to cancellation which then makes it illegally being here.

I'm torn on this one. If he wasn't here illegally, he has to have committed an actual crime, right? Did he?

What has been her response?

I think the circumstances suggest that she will fall in line with whatever her boss wants. As you know, she's not an Article III judge. She can be fired at any time for any reason by the Attorney General.

20 immigration judges were recently fired without explanation. Bondi suspended the DOJ lawyer who admitted that Abrego Garcia was illegally deported to El Salvador.

No. Congress has said he does not have to commit a crime to be deported.

That's a valid argument IF that is all they have.

I'll wait until the Justice Dept plays their hand of WHY

I suspect its way more than just saying stupid stuff about Israel
