All good questions. My guess is that the government is foreclosed from using any other evidence because that's all they submitted in response to "what evidence do you have?"

Lets hope that whatever the decision is that this Judge writes a complete Memo giving us all the details.

Rubio's declaration might be evidence enough. What I've read though is that the courts are generally hesitant to endorse deportation of green card holders without having committed a crime or over 1st amendment issues. Also, here's a little known factoid. Khalil also has the legal right own a gun.

Agree, but I suspect that we will see almost nothing. Again the judge is an at will employee who can be fired for any reason at any time by the same Administration that wants to deport Khalil.
My prediction of the entirety of the reasoning: "Deportable for the reasons stated by the Government."

Another fun question. What procedural and evidentiary rules apply?
On the face of it, Rubio's memo would be inadmissible hearsay.

And again a green card can be cancelled, rejected, terminated on just the idea of being a threat to the country, a criminal or just a plain piece of shitt

Interesting, never thought about that. Certainly, the basis for his determination is other people's statements.
Federal Rules of Evidence are not used in immigration courts. At least according to my quick google search.

I hope he is found to be deportable and is removed as soon as possible

I'm with you if all the allegations against him are true. I'd like to hear his side of the story.

Shocker. Most of our resident “lawyers” were wrong again

Well not yet, he gets to appeal.

Just take your L brother.

I am genuinely surprised but ecstatic. I was expecting the traditional "no standing" dismissal.

I am guessing this goes on for a while.
