If the enemy aliens act is a war time only power…

What declared war were we engaged in 1798? Like officially declared war? Or 1918 when it was amended to allow expulsion of females under the act?
Spoiler we were in a couple of undeclared wars with pirates, France and English navies in 1798. In 1918 we were in numerous undeclared military actions in central and South America.
Ergo the idea that it is a war time power only is very flawed.

AUMF.
Look it up.

It’s not “war time only”.
I reject the premise.
There are 3 separate qualifiers.

Even if the premise is correct.
AUMF.
The executive currently has war time authority from congress.

That is a legislative power. Not an executive power.
With that said the legislative branch as provided war time power to the executive under the AUMF.

No declaration of war was made. We were on the brink of war with France, England, and Muslim Pirates. But no war was declared. And the powers in the act were exercised multiple times. So the premise a declaration of war is required is completely without merit.

??
The Authorization for Use of Military Force (AUMF) is a U.S. law passed in 2001 authorizing the President to use military force against those who planned, authorized, committed, or aided the September 11th attacks, or harbored such organizations or persons.

People keep bringing up the AUMF. Last time I checked, the AUMF was still limited to the use of military force against the perpetrators of 9/11. I did a quick Google search to see if it has been broadened and found nothing, but maybe I'm missing something.
I know AUMF has been used to justify all types of military action in the Middle East by Obama, Trump, and Biden. I don't agree with it, but that ship has sailed.
But how does one claim a Venezuelan terrorist organization aided or associated with the perpetrators of the 9/11 attacks?
Just to avoid the normal confusion around here, I agree that TDA was rightfully labeled a terrorist organization and it's members should be expelled from the country. I'm simply asking how the AUMF relates to this?

GWOT?
War on Drugs?
While not "declared" the TdA fits the bill in both of the above...

A lot of weapons were sold to cartels by Muslim terrorists, and many terrorists were smuggled across the border by cartels.
They’re all part of the underground world and connected somehow. If cartels in any way took money from terror groups tp provide a service or bought items where their money helped fund them, then you can make that connection.
Think back when we were very anti communist. Pablo Escobar was a cocaine giant, and honestly we didn’t give a shite until he was expelled from Colombian Senate and started a war with the govt by funding a communist revolutionary group. Then all the sudden we cared and went hard after him. It’s basically the same principle here, cartels fricked themselves by smuggling terrorists and killing Americans with fentanyl. Had they simply kept selling weed and coke and smuggling Hispanic workers here that just wanted to work, we probably don’t give too much of a shite

It's not wartime only. If it was intended to be wartime only, then there would be no need for the bolded "or" phrase in the quote (which is contained in the text of the act) below.
quote:
Whenever there is a declared war between the United States and any foreign nation or government, or any invasion or predatory incursion is perpetrated, attempted, or threatened...and the President makes public proclamation of the event

You don’t have to be a lawyer. Just read the text. War, or …, or …

another 20 year "global war on terror"

If you believe that being invaded by millions of illegals who were sent by dictators who hate our country, commit numerous crimes against Americans, steal money that should go to Americans, bring diseases into our country that have previously been irradicated, bring in drugs that kill thousands upon thousands of our citizens, illegally vote and adversely affect our elections, and take jobs away from Americans isn't a war then you are batshite crazy.

I do not think the AEA requires a declared war and the OP has brought up some good points to support that.
Along that line of thinking - Trump did not make note of the 2001 AUMF when he made the AEA's required Proclamation. So, it appears the Administration is not basing the use of AEA against the TdA on the 2001 AUMF.
