OTs opinion on landlord behavior.

Headed into NOLA for Mardi Gras. We stay with a friend who rents a duplex Uptown. Their landlord is a couple with a young child who lives next door in the other half.

Apparently the landlord told them not to have excessive visitors this year. We’ve stayed there a few years and really aren’t partiers. No kids between any of us and our host is literally a doctor. Basically we are all responsible professionals and don’t really cause any trouble or are even loud. We walk to the parades, enjoy, and usually aren’t up late.

Can landlords really police something like that if it isn’t in the lease? My lease back home indicates no visitors may stay longer than two weeks. I find that reasonable basically to keep you from housing long term guests. Makes total sense and we agreed to it upfront.

Additionally, the landlord let herself into our friends half so she could move her car while she was out of town this past weekend so they could have more parking during parades (they are the people who put trash cans out and think that gives them the right to public parking spots). I found that incredibly inappropriate and I’d be livid 1 if my landlord let themselves into our apartment and 2 drove our car.

What’s the OTs thought? Are these people within their rights or are they terrible landlords?

Landlords should know what they sign up for when renting to people living in some parts of NOLA. That being said, i think they just want yall to be cautious of damaging the home, but again this isn't a random event. "Excessive" is not a finite number nor does it mean the same to everyone.

Just dont break shite.

Sounds to me like parking is the landlord's primary concern. Perhaps offer to park offsite? I don't really think they can stop you from having company for fewer than three days and nights, though.

Never been an issue and we’ve never broken anything. We don’t party in the house. Just sleep there and use it as a close private bathroom. I think last year they had people over for the Super Bowl (I was asleep after riding in Thoth ). Again all older professionals 30+ and not really raging partiers.

They likely don't want it to get too rowdy, as it sometimes can in NO for Mardi Gras. As for them entering the residence and driving someone else's vehicle, there are possibly some criminal violations there, but honestly, not worth pursuing unless it becomes an issue. A simple letter from an attorney should suffice if your friend doesn't feel comfortable with a potential confrontation over the matter, but that doesn need to be addressed.

I have rentals. You have the right to enjoy your rented property.. the two week thing is common to prevent “friends” from moving in or subletting..

A few people visiting for a few nights should be considered normal rental activity..

Would be pissed about this.

But, I don’t see how they would “police” the visitor thing.

ETA: I would assume they are just concerned about parking and/or noise. If neither of those things are a problem then I doubt they care how many actual “visitors” are at the property. I used to live in a rental on the parade route and we constantly had people over during Mardi Gras, it was never an issue for us (wife was in school at LSU HSC at the time).

Pretty sure you have to arrange any time you come into the rented property unless something like fire etc.. emergency…

I do not dare go into my rental without pre arranging or texting my tenants..
They are overstepping.. a simple text first asking if they could enter.. but if they did not ask for permission they trespassed.. I go into my rentals to repair stuff etc.. but always get permission from my tenants first.

I'd change the locks so my landlord couldn't trespass again.

What does the actual lease, and the local/state tenant laws say?

Google tenant rights and your state .. there are specific laws discussing rights in the common area versus inside the doors..

Unless your lease has something different the renter has rights for privacy etc..

Unannounced entry is not common from my experience.
