Bogus NY Treasury Case: Judge took less than 4 hours to review 60 page complaint and rule

The circumstances of the order in the New York case limiting the Treasury Secretary's access to Treasury systems should disgust anyone interested in the rule of law.
For some unexplained reason, Team Blue Steal chose to file their SIXTY PAGE Complaint after working hours on a Friday night in the U.S. District Court, Southern District of New York. By doing so, they assured themselves of having Judge Englemayer review their case initially, because he was the only judge assigned "emergency duty."
The relief sought by Team Blue Steal is unprecedented and presents a novel legal theory. Yet, without granting the Trump Administration a chance to respond, Judge Englemayer (late on a Friday night) IN LESS THAN FOUR HOURS was able to read and digest the Complaint AND review all the relevant statutes and cases AND decide that Plaintiffs had presented a compelling case AND issue his order.
Either Judge Englemayer COMPLETELY failed to consider the matter sufficiently OR knew in advance that the Complaint was going to be filed. The Judge issued his order restraining the Trump Administration at ONE O'CLOCK on a Saturday morning.
I hope the Trump Administration files a judicial misconduct complaint. There have to be consequences for this lawfare. Since the judiciary has so overstepped its bounds, maybe it's time for the executive to flex its muscle. No pay checks to judiciary employees until the Treasury Department is allowed to perform its duties without interference.

seems like judiciary misconduct to me. but I will wait for SFP to explain how common and normal these type of filings are.

Find a bigger judge and overrule his arse.

Our resident "principled libertarians" will pretend this is normal.

That's going to be a problem in the Second Circuit. Probably won't get relief until it reaches the Supreme Court.

And ruling ex parte when they easily could have heard the other side.

The basic unfairness of these court proceedings needs to be stressed more. "Judge Englemayer's decision to act without allowing the Trump Administration a chance to be heard goes against the American system of law."

I will say it again, the Supreme Court has defined Presidential immunity and what Trump has done falls well within what the Supreme Court defined as his Constitutional duties and hence he is immune from criminal proceedings while fulfilling his Presidential duties.
Carry on!!

Let me guess, they just had chat GPT summarize it for them

I think there's a STRONG chance that this happened at least as to Marc Elias. I can't imagine a judge in good faith not saying...on a Friday night..."Wait, this is unprecedented, I need to at least hear from the opposition and review the statutes and case law..."

See my OP about Congress and impeachment.
there is no way this action is ethical for a judge but they never fear consequences.
After the first impeachment, they all will change. It is entirely up to congress to fix these judges and it is solely within their power.
Even if no conviction in the senate, the mere trial to review all of their actions and getting democrats to approve these actions is political gain for conservatives.

Judges don't read documents to understand the arguments. They read them to find some words to back the opinion they know they want to write before they pick the document up. That does not take nearly as long.

Amen.
I was a law clerk for (an excellent, Republican-appointed) federal district judge. One day, we received a call from the Attorney General's office. I said "Judge, it's your boss on line one." He said "Unless it's 66 2/3rds of the US Senate, it's not my boss." [I know, CSB]
Of course, we want the judiciary to be able to act independently, but there are remedies for gross incompetence or corruption. I REALLY hope the Trump Administration pursues them.

The federal district judge for whom I clerked was very conscientious and kept an open mind until he heard from both sides.
On the other hand, I DID clerk for him in his first year on the bench.....

They should just ignore this ruling.
Not even the Supreme Court, much less an inferior district court, can tell the President how to run the executive branch of government.
He's saying even the Secretary of the Treasury, appointed by the president and confirmed by the Senate, cannot access the records of the Department of Treasury.
