An Oregon cyclist who was struck by an ambulance that made a right turn into him — fracturing his nose and leaving him with scrapes and other injuries across his body — has filed a $997,000 lawsuit against the ambulance provider after it scooped him up, drove him to the hospital and then billed him for the service, according to the suit.
Attorney Travis Mayor says the ambulance provider — Columbia River Fire & Rescue — sent his client, 71-year-old William Hoesch, a $1,862 bill for the ambulance ride. That’s among about $47,000 in medical expenses that Hoesch has racked up so far and another $50,000 of medical costs he expects in the future, the suit states.

Columbia River Fire & Rescue declined to comment. Allstate Fire and Casualty Insurance Co. didn’t respond to a request for comment. The suit claims that Hoesch’s uninsured or underinsured motorist coverage is obligated to cover any damages that Columbia River Fire & Rescue is unable to.
According to the lawsuit, Hoesch was pedaling through the small town of Rainier in Columbia County in October 2022 when he and the ambulance were traveling the same direction on a street that’s a mix of homes and businesses. The ambulance attempted to make a right turn onto another street, crashing into Hoesch and destroying his bicycle, according to the suit, which was filed Oct. 24.

The crash happened in front of Columbia River Fire & Rescue’s Rainier station, as the ambulance was returning from a trip.
According to police reports, the driver who struck Hoesch and a passenger in the ambulance estimated the ambulance was going between 2 mph and 10 mph when they heard a thump, stopped and saw Hoesch injured. Hoesch estimated to police that he was going 5 mph to 10 mph and said he didn’t think the ambulance was going to turn in front of him. His bicycle was crushed under the ambulance wheel.
Hoesch’s lawsuit also seeks $900,000 for pain and suffering, stating he suffered decreased range of motion, reduced grip strength and other symptoms.

That seems like a good way to drum up business.

Plaintiff attorney will happily accept that bill to be able to pump the settlement amount up just a little bit more. They'll get the $1,862 back and then some.

On one hand, it seems the cyclist did nothing wrong here. On the other, he is still a cyclist.

The insurance company will settle with him as it seems like a no-win situation for them

Bicyclist passing on the right?

lol, when the billing department doesn’t get the memo, or the risk management department doesn’t send the memo, they give the plaintiff a free shot to make them look bad.

At 71, that’s often all a man has to look forward to.

The cyclist should’ve been on the sidewalk

They provided a service, should they not have charged for those services just because he was in an accident with their vehicle? If it's determined the driver is at fault, then maybe they would reconsider the charges. But, based on the statements included in the article, it is possible the cyclist may share some fault in this.
If they passed him, then turned, I don't think there is an argument that the driver should be 100% at fault. But if they were creeping along, used their signals, and started to turn; and this guy ran into them because "he didn’t think the ambulance was going to turn", he may share some negligence here.

True story : I was working a code on a patient. As I hopped in the back of the EMS unit to assist EMS during transport I cracked my skull on the door locking pin. During the ride, doing my job, I had one hand on my head, with gauze, and the other hand pumping the bag manually breathing for the patient. When I left the hospital EMS gave me a $1200 bill for the ride, and $50 for “care”, giving me a few 4x4 gauze.
I fought it and won, but still I was dumbfounded.

IF the speeds in the article are correct, the bicyclist was going faster than the ambulance.
SO how did the ambulance catch up with him ?and turned right into him?
If's darned hard to avoid being hit by somebody coming up from behind you.
