tldr, louisiana DMV emailed dealerships saying he wasn't going to allow Tesla to be sold here. Tesla takes it to the feds, feds say louisiana is corrupt as frick and to try again

quote:

Circuit Judge Jerry Smith wrote that Tesla sufficiently alleged that the defendants had "plausible actual bias," citing emails from the commission's executive director assuring Tesla rivals that their complaints would be addressed.

LINK

so they throw the case right back to the initial judge who ruled for the dealerships and all their bullshite

Yea. The younger generations can and will look up all the information that a car salesman or real estate agent can tell you. It's just another tax you have to pay and another layer of regulation to support these people.

It is kind of messed up that they’d sell these anti oil cars in a state that’s lifeblood is oil and gas

Always makes me sad to see smug liberals drive these here. Just move to California already

Texas has the same law.

There are 14 states where direct sales are banned. Another 9 states allow direct sales but have a restriction on the number of stores.

Most of the states that allow direct sales by Tesla only allow it because of legislation that was designed recently, specifically for EVs.

NADA doing work.

Haven't followed the case, but based on the post Tesla merely survived dismissal of its case on Rule 12 grounds. Just means it won't get thrown out in the early stages and they live to fight another day.

Couldn't Tesla create Factory owned Dealerships?

I know in the fast food business some Franchise restaurants that are corporately owned either due to bad ownership or when one owner gets too old that he sells the franchises back to the corporate until a new owner is found. Even though it is corporately owned, it doesn 't mean that it is operated by the same company. It could still be a seperate entity under the same corporate umbrella.

Heck, I think Canes owns all of its locations/franchises in Louisiana.

Why Tesla could not operate the same? They setup a local Louisiana Dealer Company in each area they want to sell: Tesla of New Orleans, Tesla of Baton Rouge, Northshore Tesla, Tesla of Shreveport, Hub City Tesla of Lafayette, Bayouland Tesla, etc. It would be no different than a chain of Matt Bowers XXX of YYY.

Tesla had sued members of the Louisiana Motor Vehicle Commission, dealerships owned by individual commissioners, and the Louisiana Automobile Dealers Association in August 2022.

The Louisiana Motor Vehicle Commission is not the DMV, it’s a state commission, and the commissioners appointed to this commission also own dealerships in the state.

The fact that an ignorant civil service DMV employee even sent an email is quite interesting.

Eventually, most car sales will be direct to consumer. That's what the customer wants, and it would allow manufacturers to cut costs that get passed on to the consumer, making them more competitive.

If they're smart, they'll get ahead of that now. Start selling direct to consumer and transform their dealerships into delivery points and premier service centers with coffee shops and restaurants to attract customers that would normally go to Jiffy Lube for an oil change.

This is absolutely crazy. Can you imagine if a state banned Apple, Inc. from having Apple stores to fix iPhones?
