A longtime friend of mine is in pretty bad health… he named me executor of his estate in Will. He thinks he’s dying soon, and I’m a little overwhelmed at what’s gonna need to be done if/when that does happen. He currently has 24-7 at-home care from CNAs recommended through Hospice that I arranged over the last 3 weeks because he’s adamant that he wants to die at home.

I’ve never done this before, and while I have a very basic understanding of the overall process, I’m definitely going to need legal help as this plays out.

Do you guys have any recommendations for probate/succession attorneys in BTR that can help me in this process?

I’m currently trying to explore 24/7 care options vs nursing homes vs assisted living and quite overwhelmed with all of this and all the decisions that need to be made.

I'll ask my attorney friends if they know someone and update if I get a response. Sorry you're going through this.

We used Always Best for my mom's last few weeks. Combined with Hospice of Baton Rouge she had plenty of care almost round the clock.
Hospice was covered under insurance but adding caregivers from Always Best were good and affordable.

Probate attorney we used is very affordable and in Walker. He works in 19th jdc though. Under $3k for a simple succession with a house retirement account and vehicle.
Stephen Stafford.

It's not that hard if nobody's in dispute. If there is dissension, it will be a shitshow. If there's any possibility of disagreement, I advise you to think very carefully about whether you want to do it.

Please have open communication with all parties in the will. I had to deal with this as another family member as the excutrix of the will. It was a total nightmare of them not open to communication or resenting questions being asked. It would go as far as basically them misleading the attorney and I’d have to call the attorney and get everything straight.
And I’d have to ask them to follow the terms of the will exactly as it’s written.
A total shitshow.

I don’t foresee any dispute as he has no living family other than a sister that he hasn’t spoken to in 30+ years.

As I see it, there’s basically nothing to do unless your friend passes. Unless he wants you to have power of attorney to take care of his business while he is alive (should he become incapacitated.

Hats off to you for agreeing to take care of your friend.

Yeah I have POA and health POA if he’s incapacitated, which we’re nearly if not already at that point. I’m already paying his bills for him and paying the 24-7 care people.

It’s quite overwhelming to say the least.

I get that this isn’t your inquiry, but you are entitled to charge estate for your expenses, & should be able to have your reasonable legal fees paid from the estate.

This depends of course on the estate value. Being in good faith, which you clearly are, goes a long way. Just trying to explain that you don’t have to be all on your own through this.

Yeah, I’m not as concerned with that aspect, I just want good/sound help and advice through the process.

I’m also one of the main/primary beneficiaries of the estate, so the cost aspect isn’t a huge concern for me at this moment, just want good guidance and help navigating it all.

Joe Mengis if it’s not a litigious matter. Joe basically educates the rest of us every year on what’s new. None better.

Morgan Field Law off of Perkins is good. You can go the Kean Miller route, but they'll charge you for every nanosecond of email, voicemail, phone time, and their rates are much higher. I believe Field Law will send you a packet and will propose a flat fee if it's fairly straightforward.

Have you reached out to the attorney that created the Will?

I’ve been the Executor of an estate twice, named as an Executor in another Will, plus helped another family member who was struggling and an Executor. A couple of these involved POA and hospice care.

My advice is just do the best you can by your friend while he is still here and try not to let yourself get overwhelmed. Keep things in perspective. If the car insurance payment (etc..) is a few days late does it really matter? Once he passes the whole process moves at a snails pace. You can’t do much until you get the death cert. And even if things are in order and relatively simple it will still take around a year before process is completed.

Good luck with everything.
